چکیده:
در طول تاریخ فقاهت اسلام تا قبل از سده اخیر، در حرمت ربا هیچ تفاوتی بین ربای مصرفی و ربای تولیدی در فتوای فقهای شیعه و سنی دیده نمی شود. با گسترش نظام سرمایه داری و نفوذ آن به کشورهای اسلامی، بسیاری از تجار، صاحبان صنایع و بانکداران با مساله تحریم ربا مواجه بودند. برای حل این مشکل گروهی از فقها و عالمان دین الگوی بانکداری بدون ربا را مطرح کردند و گروهی دیگر، با ملاک ضرورت حفظ اداره زندگی اقتصادی و اجتماعی، سعی نمودند تفسیرهای جدیدی از ربا را ارائه دهند. این گروه معتقدند آنچه به صورت ربا در اسلام تحریم شده، ربا در قرض های مصرفی است و با ادله دهگانه ادعا دارند که بهره در قرض های تولیدی و تجاری ربا و حرام نیست.
این مقاله به روش توصیفی تحلیلی و با بررسی پیشینه تاریخی ربا و دلایل تحریم آن، به نقد و بررسی این ادله دهگانه می پردازد تا نشان دهد که هیچ یک از این دلائل تمام و کامل نیستند و ربا، چه در قرض های مصرفی و چه در قرض های تولیدی و تجاری از دیدگاه اسلام حرام است.
In the history of Islam، Until the last century، Shiah and Sunni scholars haven’t distinguished between consumption and production loans and riba in Islam absolutely has been forbidden. With the development of capitalism and its influence in Muslim countries، many businessmen، industrialists and bankers were faced with the problem of usury . To solve this problem، a group of theologists proposal interest-free banking model and others tried to present a new interpretation of riba with distinguishing between consumption and production loans. Based on this theory، these scholars believed conventional banking don’t have any Shariah challenge، because loans that provided by conventional banks are production loans and receiving any return on these loans is not prohibited.
This paper reviews the historical background of the prohibition of riba and the reasons for it، then with reviewing and analyzing ten reasons about the prohibition of riba، we understand there is no complete reason for differentiating riba in consumption and production loans and riba absolutely is forbidden from the point of view of Islam.
