چکیده:
رسانهها در راستای حفظ حریم خصوصی اشخاص مسئولیت دارند و در صورت نقض آن و ورود خسارت به اشخاص، باید جبران خسارت نمایند. خسارات ناشی از حریم خصوصی غالباً جنبه معنوی دارند و غالباً به صورت غیر مادی بوده و امکان اعاده کامل وضع سابق وجود ندارد. هدف تحقیق حاضر بررسی جبران خسارت ناشی از نقض حریم خصوصی در رسانهها در دو نظام حقوقی ایران و انگلستان است که با استفاده از روش اسنادی - کتابخانهای انجام گرفته است. یافتههای تحقیق نشان داد که در قوانین ایران حمایت از حریم خصوصی تحت حمایت از اشخاص در برابر هتک حرمت، حیثیت و مال به کار رفته است اما هنوز چالشهای زیادی در صیانت از حریم خصوصی و دادههای شخصی وجود دارد. در نظام حقوقی انگلستان نیز حریم خصوصی به نحو مشخص از اعتباری واحد برخوردار نیست. سوابق موجود در نظام حقوقی این کشور نشاندهنده آن است که دادگاه در بعضی موارد جبران خساراتی را برای نقض حریم خصوصی در نظر گرفته است، اما در این کشور تضمین صریح برای حق حریم خصوصی وجود ندارد. رویکرد کلی حقوق انگلیس مبتنی بر غلبه حمایت از حریم خصوصی در قالب شبه جرم و الزام به جبران خسارت و ارجاع به دیگر خطاهای مدنی است. حال آنکه رویکرد حمایتی انگلستان در مقایسه با ایران در برخی از جلوهها خصوصاً حریم ارتباطات، اطلاعات و دادهها به مراتب نسبت به ایران مطلوبتر است
The media are responsible for protecting the privacy of individuals, and in case of violation and damage to individuals, they must compensate for the damage. The aim of the current research is to compensate the media from several private systems in the laws of Iran and England, which was done using the document-library method. The research findings showed that In Iran's laws, protection of privacy is used to protect individuals against defamation, dignity and property, but there are still many challenges in protecting privacy and personal data. In the English legal system, privacy does not have a single validity. The records in the legal system of this country show that in some cases the court has considered compensation for the violation of privacy. But in this country there is no explicit guarantee for the right to privacy. The general approach of English law is based on the predominance of privacy protection in the form of quasi-crime and the obligation to compensate for damages and refer to other civil wrongs.
