خلاصة:
اهداف و زمینهها: هدف این پژوهش گونهشناسی جرایم محیط زیستی در جغرافیای طبیعی ایران است.
روششناسی: این پژوهش از نوع کاربردی است. در ابتدا، فهرست اولیه انواع جرایم محیط زیستی با استفاده از روش مصاحبه نیمهساختاریافته استفاده گردید. نمونهگیری به روش هدفمند و حجم نمونه 169 نفر تعیین گردید. کلیه مصاحبهها به صورت متن پیادهسازی و کدگذاری شدند. در گام بعد، با استفاده از آرای خبرگان و روش مقایسه زوجی، جرایم محیط زیستی وزندهی و ضریب اهمیت آنها مشخص شد. سپس، با استعلام از دفاتر حقوقی سازمانهای ذیربط، آمار تخلفات و جرایم محیط زیستی به تفکیک استانهای کشور حدفاصل سالهای 1395 تا 1398 به دست آمد.
یافتهها: جرایم محیط زیستی به 3 عامل کلان، 8 عامل خرد و 23 سنجه دستهبندی میشوند. بیشترین میزان جرایم، به ترتیب، «تخریب اکوسیستم»، «آلودگیهای محیطی» و «برداشت منابع و اثر بر تنوع زیستی» بودهاند. بیشترین درصد جرایم خرد متعلق به «آلودگی منابع آب» با 58درصد و سپس، «آلودگی خاک» با 26درصد و در نهایت، «آلودگی هوا» با 16درصد بوده است. در جرایم مربوط به «تخریب اکوسیستم»؛ بیشترین درصد «تخریب جنگلها و مراتع» با 48درصد و سپس، «تخریب تالابها و اکوسیستمهای آبی» با 35درصد و در نهایت، «تخریب کوهستان و دشت» با 17درصد قرار داشتهاند. در مورد جرایم مربوط به «برداشت منابع و اثر بر تنوع زیستی»؛ بیشترین درصد «خسارت به حیاتوحش» با 57درصد و کمترین میزان متعلق به «خسارت به زیستگاه» با 43درصد بوده است. بیشترین سنجه ارتکاب جرم «تغییر کاربری اراضی» (9.4٪) و کمترین «برداشت گیاهان دارویی» (0.5٪) میباشد. استان مازندران با 6674 مورد ارتکاب جرایم محیط زیستی در صدر استانهای کشور و استان خراسان رضوی با 232 مورد ارتکاب جرم، در انتهای فهرست قرار داشتهاند.
نتیجهگیری: نظر به تعدد و تنوع جرایم محیط زیستی در کشور و افزایشی بودن روند ارتکاب جرایم، لازم است تا اقدامات موثرتری در این خصوص صورت گیرد.
Aims & Backgrounds: The aim of this study is the typology of environmental crimes in the natural geography of Iran.
Methodology: In the first, a preliminary list of various environmental crimes was prepared. For this purpose, a semi-constructed interview method was used. Sample size was 169 people. In the next step, using expert opinions and the method of pairwise comparison, environmental crimes of weighting and their importance coefficient were determined. Then, by inquiring from the legal offices of the relevant organizations, the statistics of violations and environmental crimes by the provinces of the country between the years 1395 to 1398 were obtained.
Findings: Environmental crimes are classified into 3 major factors, 8 micro-factors and 23 metering categories. The highest crime rates were "ecosystem degradation", "environmental pollution" and "biodegradation", respectively. The highest percentage of petty crimes was "water pollution" with 58 percent, followed by "soil pollution" with 26 percent, and finally "air pollution" with 16 percent. In crimes related to "ecosystem destruction"; the highest percentage was "destruction of forests and pastures" with 48%, followed by "destruction of wetlands and ecosystems" with 35%, and finally, "destruction of mountains and plains" with 17%. In the case of crimes related to "harvesting resources and effects on biodiversity"; the highest percentage of "damage to wildlife" was 57% and the lowest rate was "damage to habitat" with 43%. The highest crime rates are "land use change" (9.4%) and the lowest are "medicinal plant harvests" (0.5%). Mazandaran province with 6674 cases of environmental crimes is at the top of the list of provinces in the country and Khorasan Razavi province with 232 crimes.
Conclusion: Given the multiplicity and diversity of environmental crimes in the country and the increasing trend of crime, it is necessary to take more effective measures in this regard.
