خلاصة:
سوال اساسی که در زمینه ی دادرسی مدنی از قدیم الایام مطرح بوده، این است که آیا دادرس در زمینه ی کشف حقیقت نیز می تواند اقدام کند یا اینکه نقش او منحصر در فصل خصومت با توجه به دلایل ابرازی طرفین است. استجواب یا بازجویی مدنی به معنای پرسش از اصحاب دعوا با احضار شخصی ایشان،نوعی ترتیب تحقیقی است که درراستای اعطای نقش فعال و پویا به دادرس در مقررات آیین دادرسی مدنی فرانسه،تحت عنوان حضور شخصی اصحاب دعواو برخی کشورهای عربی تحت عنوان استجواب مقرر شده است وهمانند بازجویی در امور کیفری می تواند به حصول قرینه، اماره یا اقرار از اظهارات طرفین منتهی گردد.در حال حاضر تنها ماده قانونی که از آن می توان بازجویی مدنی یا استجواب را در حقوق ایران استنباط نمود، ماده ی199قانون آیین دادرسی مدنی است که به دادرس امکان انجام هر گونه اقدام وتحقیقی را در جهت کشف حقیقت داده است.چون استجواب به طور صریح در قوانین مدون ایران پیش بینی نشده و توسط دکترین هم مورد شرح وتبیین قرار نگرفته است، لذا شایسته است که قانون گذار همانند کشور های فرانسه ولبنان که مقررات دقیق و روشنی در رابطه با استجواب پیش بینی نموده اند به قانونگذاری در این مهم اقدام نماید.
