خلاصة:
زمینه و هدف: تضمین اشتغال زنان و برابری جنسیتی بهعنوان یکی از چالشهای مهم بینالمللی است که در حقوق نوشته اکثر کشورها مورد بررسی قرار گرفته است. در پژوهش حاضر سعی شده است با بررسی حقوق کشورهای ایران، فرانسه، مصر و همچنین رویة قضایی، این مسئله تبیین شود.مواد و روشها: مقاله حاضر توصیفی-تحلیلی است و برای گردآوری اطلاعات از روش کتابخانهای استفاده شده است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانتداری رعایت شده است.یافتهها: فقه و نظام قضایی ایران، مصر و فرانسه هر یک به شیوهای به حق اشتغال زنان نگریستهاند و این اختلاف نظر و عقیده در متون قانونی و رویة قضایی با توجه به منشأ و مبنای آن متفاوت است. حقوق مصر برابری بین شهروندان را بدون تبعیض بر اساس جنسیت مورد توجه قرار داده است و بین زن و مرد در حق کار، تبعیض قائل نمیشود. حقوق فرانسه، با چشمانداز وسیعتری حق برابری زنان را مورد تأیید قرار داده است.نتیجهگیری: حق اشتغال هر فرد اعم از زن و مرد یکی از حقوق اساسی انسان هاست که در اسلام به رسمیت شناخته شده است. از طرفی ریاست شوهر در خانواده و لزوم تمکین زوجه از وی نیز از جمله حقوقی است که اسلام بر آن پافشاری دارد. اعمال این دو حق، موجب بروز اختلافات حقوقی بین زوجه میشود.
Background and Aim: guaranteeing women's employment and gender equality is one of the important international challenges that has been examined in the written laws of most countries. In the present study, an attempt has been made to address this issue by examining the laws of Iran, France, and Egypt, as well as judicial practice.Materials and Methods: This article is descriptive and analytical and library method is used.Ethical Considerations: In this article, the originality of the texts, honesty and trustworthiness are observed.Findings: The jurisprudence and judicial system of Iran, Egypt and France have each looked at women's right to employment in a different way, and this difference of opinion and opinion in legal texts and judicial procedure is different according to its origin and basis. Egyptian law has paid attention to the equality between citizens without discrimination based on gender and does not discriminate between men and women in the right to work. French law has approved women's right to equality with a broader perspective.Conclusion: The right to employment of every person, both men and women, is one of the basic human rights recognized in Islam. On the other hand, the headship of the husband in the family and the need for the wife to obey him is one of the rights that Islam insists on. Exercising these two rights causes legal disputes between wives.
