Abstract:
اشتمل القانون الدولی الإنسانی ضمانات أساسیة تستهدف حمایة بعض فئات من الأشخاص، کأفراد الخدمات الطبیة وحمایة بعض الأعیان المدنیة ومبدأ حمایة البیئة الطبیعیة؛ بحمایة خاصة أثناء النزاعات المسلحة الدولیة أو غیر الدولیة. وقد جاءت هذه الدراسة لتبیان ما مدی الحمایة القانونیة الخاصة التی أولاها القانون الدولی الانسانی لأفراد الخدمات والبعثات الطبیة وکذا الحمایة القانونیة للأشخاص المشارکون فی عملیات حفظ السلام) کمبحث أول (، کما نتساءل عن مدی الحمایة القانونیة الخاصة التی کفلها القانون الدولی الانسانی للممتلکات الثقافیة بمختلف أصنافها وحمایة البیئة الطبیعیة اثناء
النزاعات المسلحة (کمبحث ثانی). وللإجابة عن هذه الإشکالیة، فقد سلکنا منهج تحلیلی، وقفنا عبره علی تحلیل أحکام وقواعد القانون الدولی الانسانی المتصلة بموضوع بحثنا، کما قمنا بتبیان بعض الأحکام القضائیة و الآراء الفقهیة وتحلیلهما، للوقوف حول جدیة قواعد القانون الدولی الإنسانی فی وضع حمایة قانونیة خاصة لهذه الفئات من الأشخاص وهذه الأعیان الثقافیة والبیئة الطبیعیة.
International humanitarian law includes basic guarantees aimed at protecting certain categories of persons,
such as medical personnel, protection of some civilian objects, and the principle of protecting the natural
environment. With special protection during international or non-international armed conflicts.
This study came to show the extent of the special legal protection that international humanitarian law has
assigned to the personnel of medical services and missions, as well as the legal protection for people participating in
peace-keeping operations (as a first study). We also ask about the extent of the special legal protection that
international humanitarian law has guaranteed for cultural property of all kinds and the protection of The natural
environment during armed conflicts (as a second topic).
To answer this problem, we took an analytical approach, through which we analyzed the provisions and rules
of international humanitarian law related to the subject of our research, and we also clarified and analyzed some
judicial rulings and jurisprudential opinions, to stand on the seriousness of the rules of international humanitarian
law in the development of special legal protection for these groups of persons These are the cultural objects and
the natural environment.
