Abstract:
به منظور تحقق اهداف نظام اسلامی، انتخاب افراد اصلح برای تصدی مناصب حکومت اسلامی، ضرورتی اجتنابناپذیر است. در گذشته تصدی مناصب اجتماعی برای زنان، امری مثبت تلقی نمیشد؛ لکن افزایش جمعیت بانوان به بیش از نیمی از جمعیت جامعه و وجود بانوان صالح و اصلح، انگاره مذکور را دچار ابهام و تردید کرده است. لذا این سؤال مطرح میشود که آیا مذموم دانستن تصدی مناصب سیاسی توسط زنان، ناشی از مستندات فقهی و شرعی است؟ تحقیق حاضر با روش تحلیلی ـ اجتهادی اثبات میکند که زنان اصلح میتوانند و گاه باید عهدهدار مناصب و مشاغل حکومتی شوند و تنها در برخی مناصب خاص، تصدی آنان جایز نیست. بنابراین از منظر فقهی انگاره مذکور به صورت کلی قابل تأیید نیست؛ بلکه اصل و قاعده کلی جواز تصدی مناصب حکومتی توسط زنان است و تنها مواردی که دارای شرایط یا دلیل ویژهای است، از این قانون استثنا میشود.
In order to achieve the goals of the Islamic system, the appointment of the most eligible people to hold positions in the Islamic government is an inevitable necessity. Previously, women's holding positions was not considered a positive and a welcome phenomenon but the fact that women constitute more than half of the population and the existence of competent and qualified women have made some people to cast doubt as to whether women should be allowed to hold positions or not. Therefore, the question arises whether the condemnation of women holding political positions is supported by any jurisprudential and religious proofs. The present study proves by analytical-inferential method that righteous women can and sometimes should hold government positions and jobs, and they are not allowed to hold only certain positions. Therefore, from the jurisprudential point of view, this idea cannot be approved in general; rather, the general principle is that it is permissible for women to hold government positions. As for those cases with special conditions or reasons, they are excluded from this general principle.
