Abstract:
به موازات توسعه الزامات قانونی، قانونگریزی، اجرای متقلبانه و تقلب نسبت به قوانین نیز افزایش یافته است. مقابله با تقلب، در راستای خنثی کردن نتایج خسارت بار آن، به مرور عالمان فقه و حقوق را بر آن داشته تا نظریه عمومی اجرای متقلبانه قوانین را مطرح نمایند. کشورهای متمدن که بیروح شدن و خنثی سازی الزامهای قانونی را بر نمیتابند، فرایندی شتابان و منسجم در پذیرش نظریه مذکور داشتهاند. لازم به ذکر است، اندیشه فقها در غنی کردن و تایید نظریه ی مذکور، در قالب نهاد حیل، براین مسئله مهم دامن زده است. مطالعه اندیشه و سیره امام خمینی (ره) بیانگر آن است که ایشان ضمن تاکید بر تدوین قوانین اسلامی و عادلانه، اجرای دقیق و صحیح مقررات و احکام و تبعیت از قانون، از تقلب نسبت به قوانین و احکام نهی نموده است. به نظر میرسد هنوز هم برخی صاحبنظران، در پذیرش این نظریه تحت عنوان یک نهاد مستقل و اختصاصی، تردید دارند، با وجود این، وجود قرائن و نشانههایی در حقوق موضوعه ایران، حقوق بین الملل و حقوق اسلام، امیدهایی را در پذیرش این نظریه، با ضمانت اجرای اختصاصی عدم قابلیت استناد به عمل متقلبانه ایجاد نموده است.
In parallel with the development of legal requirements, lawlessness, fraudulent enforcement and fraud against the law have also increased. Civilized countries that do not tolerate the demoralization and neutralization of legal requirements have had an accelerated and coherent process of accepting this theory. It should be noted that the thought of jurists in enriching and approving the above theory, in the form of the institution of deceit, has fueled this important issue. A study of Imam Khomeini's thought and manners shows that while emphasizing the formulation of Islamic and just laws, the accurate and correct implementation of rules and regulations, and obedience to the law, he forbade cheating on laws and rules. It seems that some scholars are still skeptical of accepting this theory as an independent and exclusive institution, however, the existence of evidence in Iranian law, international law and Islamic law, hopes to accept This theory, with the guarantee of specific implementation the inability to invoke fraudulent action, has created .
