چکیده:
حقوق رقابت مجموعه قواعد و مقرراتی است که هدفش حفظ رقابت در بازار و مقابله با
بروز اعمال ضدرقابتی است. از این مقررات به عنوان یکی از ضروریات نظا مهای اقتصاد بازار
آزاد و از جمله مه مترین مولفه های توفیق آن ها یاد م یشود. تصور بر این است که اگر رقابت
سالم در بین فعالان عرصه تولید و توزیع حاکم باشد، کارایی اقتصادی به بار آمده و درنهایت
رفاه عمومی افزایش می یابد.
بااین که مدت ها است این شاخه نوین حقوقی مباحث بین رشته ای جذاب و پردامنه ای را میان
حقوق و اقتصاددانان برانگیخته، اما نظام حقوقی کشورمان در این عرصه به تازگی گامهای
نخستین را برداشته است. لذا لازم است از هم اکنون مقدمات و اصول و قواعد زیربنایی
این حوزه موشکافانه بررسی شده و مسیر پژوهش های عمیق تر آتی هموار شود. یقینا یکی
از مهم ترین و مبنای یترین پرسش ها درمورد هر قانون جدیدی، قلمرویی است که در آن
محدو ده لازم الرعایه است. درمورد حقوق رقابت می توان قلمرو مقررات آن را از سه جنبه
قلمرو شخصی، موضوعی و مکانی بررسی کرد. این مقاله به جنبه نخست اشاره داشته و با
مطالعه ای تطبیقی م یکوشد پاسخی شایسته به این سوال مقدماتی ارائه دهد که چه اشخاصی
باید رقابت را حفظ کرده و قواعد آن را رعایت کنند.
Competition law encompasses rules and regulations which set goal of preserving competition in the market and preventing anticompetitive practices. These rules are conceived as necessary for free market economies and one of the most important components of success of such economies. The idea is that if free competition exists among activists at production and distribution of goods and services، economic efficiency and ultimately total welfare will increase.
While this new branch of has long provoked fascinating interdisciplinary discussions among economists and lawyers، the legal system of Iran has recently taken the first step in this field. So it is required that from now that the underlying premises and principles of this area of law are properly discussed and examined to pave the way for deeper future researches. Certainly one of the most important and basic questions about any new regulations is the scope of its application. The realm of competition law rules can be investigated from three angles: personal، subject and location. This article discusses the first aspect and tries to provide a comparative study to answer the question that: who are required to preserve competition and observe its rules?
