چکیده:
در این پژوهش به «قبح نقض غرض» بسان یک قاعدة فقهی پرداخته شده است و مهمترین پیش فرضها و نتایج آن و پیشینه فقهی و گسترة بهکارگیری آن درمیان فقها مورد بررسی قرار گرفته است. جواز و تشریع احکامی همچون استفاده از حیله به منظور فرار از ربا، پژوهشی در خور، پیرامون امکان تشریع احکام منافی با اهداف دیگر احکام را میطلبد. جستجوی دیرینة این قاعده در منابع نخستین فقه و آثار علمای این عرصه، و نیز کنکاش در مفردات قاعده و مشخص نمودن پیش فرضهای آن، ساختار اصلی جستار حاضر را سامان داده است. وجود نشانههایی از التزام فقهای متقدم و متاخر به قاعدة قبح نقض غرض، بخصوص امام خمینی که با بهره گیری از این قاعده، قائل به ممنوعیت به کارگیری حیلههای فرار از ربا شدهاند. از پذیرش همگانی آن در عین به کارگیری محدود آن در فرآیند استنباط، خبر میدهد. همچنین باور به وجود حسن و قبح عقلی، غرضمند بودن خداوند متعال در تشریع احکام، مشخص بودن اغراض و حتمی بودن نقض آنها، از جمله مواردی است که قاعدة قبح نقض غرض، در کارکرد خویش بدانها نیازمند است.
Consultation in management of affairs which is recommended by rational people, means enjoying the viewpoints of others in taking a decision that is closer to an appropriate one. There is no doubt that consultation is useful, but whether consultation is obligatory for the Islamic ruler who has religious and legal prerogatives is under investigation.
The advocates and opponents of the necessity of consultation have relied on textual (the Book and Tradition) and non-textual reasons to support their arguments. The present paper is an attempt to study the rational reasons for the necessity of consultation in governmental decision-making. The findings of this paper indicate that the ruler is bound to follow the viewpoints of the advisors after consultation when their viewpoints qualitatively and quantitatively override his own viewpoints. This is a different understanding of the Holy Quran’s verse on consultation. Consultation in the government system is in contrast with religious dictatorship, referred to by Allamah Naini.
