چکیده:
در قانون اساسی جمهوری اسلامی ایران، تفکیک قوا به نوعی تجلی یافته و قوای حاکم مجریه،
مقننه و قضاییه مستقل از یک دیگرند. اگرچه استقلال قوه ی قضاییه از ویژگی خاصی برخوردار است
و قوای دیگر از جمله قوه ی مقننه بر روی آن نفوذ و اقتدار چندانی ندارد و هیچ گونه راهی برای سوال،
استیضاح و عزل مسوولین قو هی قضاییه مشاهده نمی شود، با وجود این، بعضی از اختیارات و وظایف
قوه ی مقننه می تواند بر روی قوه ی قضاییه تاثیر گذار باشد و بر یک نوع اقتدار نسبی دلالت داشته باشد.
پاسخگویی دستگاه قضایی در برابر مجلس بر اساس اصول ٧٦ و ٩٠ قانون اساسی در زمینه ی
مسوولیت پشتیبانی و احقاق حقوق عامه و پاسداری و گسترش امنیت و آزاد یهای مشروع می تواند
یکی از مظاهر چنین اقتداری تلقی شود. با هدف ماندگاری و اقتدار نظام مردم سالاری دینی، قوه ی
قضاییه باید در راستای تبیین، استحکام و نهادینه کردن عدالت قضایی در برابر مجلس و مردم
پاسخگو باشد.
The Separation of Powers is basically found in the Constitution of the Islamic Republic of Iran. Thus the rulling powers i.e. the Executive Powers، the Legislature and the Judiciary are separated from the others. Although the independence of the Judiciary system
has got its own particular characteristics، to have authority over it، also leaving no other alternative for the impeachment، interpellation and deposition of the judiciary in charge، there may still be circumstances where some powers and duties of the legislature can impress upon the judiciary system. This impression is indicative of a kind of relative
authority of the parliament. The responsibility of the Judiciary against the Parliament under the Constitution of Iran (principles 76 & 90) concerning duty of support and administration of public rights، keeping and extension of security and lawful freedom may be one of the appearances of such authority. Bearing in mind the objective of
steadiness and power of religious democratic regime، the Judiciary shoud be respondent against the parliament and people in order to explain، stabilize and institutionalize the judicial justice.
