چکیده:
هدفت الدراسة الی بیان الخصائص الممیزة للبنوک الاسلامی عن غیرها من البنوک التقلیدیة، وسعت الدراسة لبیان أثر هذه الخصائص علی طبیعة التمویلات التی تجری فی المصارف الاسلامیة. و خلصت الی وجود فروقات جوهریة بهذه الخصائص انعکست علی طبیعة المعاملات و ما یجب أن تکون علیه. و توقفت عند أبرز الفروق منها الأساسی العقدی الذی تقوم علیه، و الالتزام بأحکام الشرع فی المعاملات، و تحریم الفائدة البنکیة، و طبیعة علاقة الوساطة المصرفیة و تکییفها القائم علی المشارکة، و قیام المصارف الاسلامیة علی أسس أخلاقیة و وظیفة اجتماعیة و استثمارات حقیقیة. و أوصت الدراسة بالارتقاء بعملیات استثماریة حقیقیة قائمة علی المشارکة و المضاربة، و التقلیل من ما أمکن من العقود القائمة علی المداینات، کما أوصیت بتسهیلات قانونیة فی النظم المصرفیة بما ییسر عملها فی الدول التی تعمل فیها.
This study aimed to show the characteristics of Islamic banks that distinguish them from
other conventional banks. The study also sought to explain the effect these characteristics have on
the nature of the financing carried out in Islamic banks. And concluded that there were significant
differences in these characteristics that were reflected in the nature of the transactions and what
they should be. The study mentioned the most prominent differences, such as, the basis of the
contract, abiding by the provisions of Sharia in transactions, the prohibition of banking interest,
the nature of the relationship of banking mediation and the adaptation of participation, and the
establishment of Islamic banks on the basis of ethics, social functions and real investments. The
study recommended upgrading real investment based on participation and speculation, while
minimizing existing debt based contracts, and recommending legal facilities in banking systems to
facilitate their work in the countries where they operate.
