چکیده:
در فقه اسلامی برای احقاق حقوق قربانی و متهم در جرائم مربوط به نفس و عضو، شرایطی در نظر گرفته شده است پرسش این است که آیا امکان تبعیض در قصاص عضو وجود دارد به این معنا که مجنی علیه و یا ولی، نسبت به جانی، بخشی از قصاص را اجرا و بخشی دیگر را عفو یا مصالحه کند؟ در این مسئله سه دیدگاه فقهی وجود دارد: یک- تبعیض در قصاص کلا پذیرفته شده است. دو- تبعیض در قصاص، تنها برای مرد قابل پذیرش است. سه- بر پایه قول به تفصیل در قطع چهار انگشت زن توسط مرد، زن میتواند دو انگشت مرد را به عنوان قصاص قطع کند و چیزی به عنوان مازاد بر دیه به مرد رد نمیکند، ولی وی نمیتواند سه انگشت مرد را قطع و یک انگشت را عفو کند. در این تحقیق با نقد دو دیدگاه اول و دوم، قول به تفصیل پذیرفته شده است.
In Islamic jurisprudence، some preconditions have been taken into consideration for restoring the rights of the victim and the accused in crimes related to homicide and organ defect. The question is whether there is the possibility of discrimination in qi?a? (retaliated punishment) for body organs; that is to say، can the victim or the claimant execute part of qi?a? and forgive or compromise another part in regard to the criminal? There are three legal views concerning this issue: 1. Discrimination in qi?a? is quite accepted; 2. Discrimination in qi?a? is accepted only for men; 3. According to the view on detail in cutting off four fingers of a woman by a man، the
woman can cut of two fingers of the man as qi?a? and does not pass on something as blood money (diya) to the man. But she cannot cut off three fingers of the man and forgive one finger. In this research، the first and the second viewpoints are critiqued and the view on detail is accepted
