چکیده:
مقدمه: در عصر حاضر امکان حفظ اندامهای حیاتی بدن با توجه به پیشرفتهای عظیم صورتگرفته در علم پزشکی واقعهای دور از ذهن نبوده و بهرهگیری از علوم و تجهیزات پزشکی موجب شده تا نجات جان بیماران و بازگشت مجدد حیات به آنان ممکن شود. هر چند استفاده از این امکانات در اکثر مواقع کارگشا بوده و نتایج رضایتبخشی را نیز بهدنبال داشته است، لیکن در مواقع خاصی نیز بهدلیل ماهیت بیماری، کهولت سن، ابتلا به یک بیماری زمینهای یا دیگر عوامل مشابه، عملکرد اندامهای حیاتی بدن دچار اختلال شدید شده، به گونهای که حتی دانش پزشکی نیز از درمان آن عاجز است و عملاً هیچ اقدامی را در جهت حفظ بقا و استمرار حیات بیمار نمیتوان به انجام رساند؛ موضوعی که موجب شده مباحثی پیرامون عدم انجام احیا در مواجهه با این گونه بیماران شکل گیرد. اگر چه اقدام به DNR یا عدم انجام آن بحثهای فلسفی و اخلاقی زیادی را معطوف به خود کرده است، اما از جنبه حقوقی و قانونی نیز میتوان به این قضیه نگریست. هدف این مطالعه، تحلیل دستور عدم احیای بیماران فاقد حیات مستقر با استناد به ماده ۳۷۲ ق.م.ا بود.
نتیجهگیری: با استفاده از مفهوم مخالف ماده ۳۷۲ ق.م.ا میتوان از عدم مداخله کادر درمان در مواجهه با بیماران در حال احتضار و طیشدن روند طبیعی مرگ این اشخاص از طریق این ماده جرمزدایی کرد.
Introduction: In the present era, it is possible to maintain vital organs considering the major advances in medical science. Saving the lives of patients and resuscitation their life is possible through medical science and instruments. Although the use of medical instruments is beneficial in most cases and have satisfactory results, but in some cases, severe disorders are observed in function of vital organs because of aging, systemic disease, and the other similar factors so that the medical science is unable to treatment the diseases and no action can be taken to maintain patient's life. This topic has led to discussions about “do not resuscitation” order in the face of these patients. Although philosophical and moral discussions have been raised in this regard it can also be investigated in terms of the legal perspective. The aim of the present study was to analysis of “do not resuscitation” order in patients without established life based on article 372 of the Islamic penal code.
Conclusion: It is possible to criminalization of the medical staff in terms of their nonintervention in the resuscitation of dying patients using the opposite concept of article 372 of the Islamic penal code.
