چکیده:
هدف: مقاله حاضر به دنبال تببین وضعیت حقوق بیمۀ ایران و تحولات آن در زمینۀ قایممقامی در حوادث رانندگی است و با ملاحظۀ مشکلات شرکتهای بیمه و صندوق تامین خسارتهای بدنی در بازیافت خسارت، نشان میدهد که قایممقامی در حوادث رانندگی به صورت اصولی اجرا نمیشود. روششناسی: پژوهش حاضر مطالعهای تطبیقی است که با استفاده از روش کتابخانهای و مراجعه به متون قانونی و منابع مربوطه تدوین شده است. یافتهها: معایب و دشواریهای قایممقامی در «قانون بیمه اجباری خسارات وارد شده به شخص ثالث در اثر حوادث ناشی از وسایل نقلیه»، حصول نتایج مطلوب جانشینی را محتمل و میزان بازیابیِ خسارات را ناچیز میسازد. متقابلاً با عدم بازیافتِ بهموقع و کامل خسارات، نمیتوان بازدارندگیِ آرمانی را از دعوای جانشینی در حوادث مذکور انتظار داشت. همچنین، این دعوی نه تنها، منبع تأمین مالیِ موثری برای بیمهها و صندوق تأمین خسارتهای بدنی محسوب نمیشود، بلکه گاه صرفۀ اقتصادی نیز به همراه ندارد. قانونگذار نیز علیرغم شناسایی قایممقامی، ضمانت اجرای موثری برای بازیافت خسارت در نظر نگرفته است. نتیجهگیری: دعوای جانشینی نباید بهطور کامل حذف گردد، اما با اصلاح شیوۀ قایممقامی و تمهید جانشینی اداری و تدابیر غیرقضایی میتوان هزینهها را کاهش داد و تحقق کارکردهای مورد نظر جانشینی را به نهادهایی که برای این هدف مناسبتر هستند، واگذار کرد.
Objective: This paper is intended to explain the status of the Iranian insurance law and its mutations in subrogation. Hence, we illustrate the problems facing insurance companies and the Physical Injuries Compensation Fund in the absence of that sound application of claim subrogation. Methodology: The present study is a comparative study compiled using the library method and referencing legal texts and related resources. Findings: In the absence of full and prompt subrogation recovery of damages from negligent third party, subrogation cannot be fully functional. In addition, in this circumstances, it is neither financially nor economically useful for insurance companies. Furthermore, despite recognizing the subrogation by legislator, it is not supported and guaranteed by a practical solution. Conclusion: Subrogation should not be completely removed, but some reforms, such as modifying the succession method, administrative subrogation and non-judicial remedies can reduce the costs and transfere the desired functions to the institutions that are most appropriate for this purpose.
