چکیده:
با توجه به اهمیت قانون کار در تنظیم روابط کارگر و کارفرما و نقش تعیینکننده آن در پیشرفت اقتصادی بنگاههای تولیدی، این تحقیق با هدف "تحلیل قانون کار جمهوری اسلامی ایران از دیدگاه کارفرمایان از منظر مدیریت منابع انسانی" انجام شده است. تحقیق از نظر هدف، کاربردی و در تجزیهوتحلیل دادهها از روش نظریۀ دادهبنیاد استفاده شده است. جامعه آماری این تحقیق را کارفرمایان شرکتهای صنعتی مستقر در استان تهران تشکیل میدهند که با روش نمونهگیری گلولهبرفی و بر اساس قاعده اشباع نظری با هشت نفر از این کارفرمایان مصاحبه عمیق صورت گرفته است. نتایج تحلیل دادهها نشان داد که مهمترین ضعف قانون از نظر کارفرمایان، عدم شفافیت و استنباطهای مختلف از متن قانون و اختیارات محدود کارفرما در قانون کار میباشد. بنا بر نظر کارفرمایان، قانون فعلی نمیتواند چندان در داوری بین کارگر و کارفرما موثر واقع شود و این امر باعث میشود شکاف بین شرایط واقعی حاکم بر منابع انسانی و محتوای قانون گسترش یابد. با توجه به عرضه زیاد نیروی کار به ویژه نیروی تحصیل کرده، بنگاهها به سادگی به نیروی کار دسترسی دارند و این موجب شده است که کارفرمایان، کم توجه به قانون کار، هزینه چندانی برای جذب و نگهداشت نیروی انسانی صرف نکنند.
Regarding the significance of the labor law in the relationship between employer and employee and its determining role in economic development, this study intends to analyze the labor law on the part of employers from perspective of human resources management. Considering the objectives of the study, it is an applied research, and the grounded theory is applied for data analysis. Statistical population includes employers of industrial companies located in Tehran among whom sampling is conducted through theoretical saturation and in-depth interviewing is utilized as the data collection instrument. The results showed that in employers’ point of view, the most important drawback of the abovementioned law is lack of clarity and its various probable interpretations, as well as the limited authority considered for the employers. Also, in employers’ point of view, current law cannot be so effective in judging between the worker and the employer. This will widen the gap between the real conditions governing human resources and the content of the law. Given the high supply of labor, especially the educated force, firms simply have access to the workforce. This has caused employers with little regard to labor law, do not spend a lot to attract and retain human resources.
