چکیده:
مقاله حاضر درصدد معرفی و مقایسه دیدگاه برخی از متفکران مسلمان در فلسفه فقه در باب «رابطه اخلاق و شریعت» با دیدگاه برخی از متفکران غربی در فلسفه حقوق در باب «رابطه اخلاق و قانون» است. در باب رابطه اخلاق و قانون دو دیدگاه اصلی در فلسفه حقوق وجود دارد: یکی نظریه قانون طبیعی و دیگری نظریه اثباتگرایی حقوقی. بر همین قیاس، در باب «رابطه اخلاق و شریعت» نیز دو دیدگاه اصلی در فلسفه فقه وجود دارد: یکی نظریه عقلگرایان (عدلیه) و دیگری نظریه فرمان الاهی (اشاعره).
هر یک از این چهار دیدگاه خوانشهای متنوعی دارند. در عین حال، وجه مشترک خوانشهای متنوع اثباتگرایی در فلسفه حقوق عبارت است از انکار وجود رابطهای ضروری میان اخلاق با ماده (محتوا) و صورت (شکل) قانون، و وجه مشترک خوانشهای متنوع از نظریه قانون طبیعی پذیرش وجود چنین رابطهای میان اخلاق با ماده یا صورت قانون است. از سوی دیگر، وجه مشترک خوانشهای مختلف نظریه فرمان الاهی و عقلگرایی به ترتیب عبارت است از وابستگی اخلاق به شریعت، و انکار این وابستگی.
دیدگاه عدلیه و اشاعره در مورد رابطه اخلاق و شریعت به ترتیب با برخی از خوانشهای اثباتگرایی و برخی از خوانشهای قانون طبیعی قابل مقایسه است. این مقایسه میتواند به فهم بهتر و عمیقتر هر دو سوی مقایسه کمک کند و در راستای پالایش تفسیر و اجرای قانون دینی و عرفی به مفسران و مجریان قانون کمک کند.
The aim of this article is to introduce and compare the views of some Muslim thinkers in philosophy of Islamic Jurisprudence (fiqh) regarding the relationship between morality and the positive religious law (Shariʿah) with the views of some Western thinkers in philosophy of law regarding the relationship between morality and the positive secular law. In each camp we have two major rival views to be compared, i.e., Moral rationalism vs. the Divine command theory, and Natural law theory vs. Legal positivism. Although each of these theories has been variously formulated and interpreted over time, the central tenet in Legal positivism is that there is no necessary relationship between morality and the content or form of law, whilst Natural law theory is grounded on the acceptance of the existence of just such a relationship. On the other hand, in philosophy of fiqh, the various formulations of the Divine command theory are centred on the dependence of morality on Shariʿah whilst all readings of rationalism deny such a dependence. Certain formulations of the Divine command theory and Moral rationalism can be compared with particular readings of Legal positivism and Natural law theory, respectively. This comparison can help to deepen our understanding of all four theories and aid legal interpreters and executors in the refinement and implementation of religious and secular positive law.

در فلسفة حقوق، طرفداران «نظریة قانون طبیعی» (Natural law theory) از دیدگاه شمارة (1) دفاع میکنند؛ اینان به وجود هنجارهای اخلاقی به عنوان «هنجار برتر» و مستقل از قانون وضعی (عرفی) باور دارند، و قوانين (عرفی) موضوعه را بهنحوی از انحا متأثر از آن هنجار برتر ميدانند؛ يعني بر این باورند که قانونیت این قوانين یا اعتبار آنها در گِروی سازگاری آنها با اخلاق است.
(Beyleveld & Brownsword, 1994: 1-31) اما از نظر طرفداران «نظریة اثباتگرایی حقوقی» (Legal positivism) (دیدگاه شمارة 2) هنجار برتر یا اساساً وجود ندارد، یا خود بخشی از قانون است، نه مستقل از قانون و برتر از آن، و ایـن هنجـار برتر لزوماً اخلاقی نیست، هرچند ممکن است از اخلاق سرچشمه گرفته باشد چنانکه خواهیم دید این دو دیدگاه خوانشهای متعددی دارند و در طول تاریخ بحث از این رابطه به شکلهای متنوعی ظاهر شدهاند.
