چکیده:
: مراجعه به فتوای فقها در سنجش اسلامی بودن قوانین، در مواردی که اختلافنظری در بین نباشد، سهل است، اما در موارد اختلاف فتوا، انطباق قوانین با احکام اسلامی، بر چه اساسی باید صورت بگیرد؟ در این خصوص نظریات مختلفی مطرح است؛ از معیار بودن فتوای ولیفقیه گرفته تا فقیه اعلم، شورای نگهبان، نظریة مشهور و غیر آن. هیچیک از این نظریات خالی از اشکال نیست و همگی نیازمند تنقیح و توضیح است که بدون بازخوانی مباحث اجتهاد و تقلید امکانپذیر نیست. کتاب اجتهاد و تقلید مانند بسیاری از صفحات فقه شیعه، بدون در نظر داشتن مسائل اجتماعی و سیاسی تدوینشده و مبانی تقلید که مناسبتی تام با تقلید فردی دارد، در بسیاری از موارد برای مدیریت امور اجتماعی نارساست. مقالة حاضر تلاش دارد تا با روش تحلیل و مطالعة کتابخانهای، ابتدا مواضع این ابهامات را نشان دهد، سپس راهی برای رفع اشکالات نشان دهد. نظریة مصالح عامة شهید صدر، با رفع برخی آفات نظری، بهضمیمة رویة فکری و عملی امام خمینی، میتواند نشاندهندة مبنایی تازه برای حل مسئلة فتوای معیار باشد. نظریهای که میتوان آن را «فتوای تابع مصالح الزامی» نامید.
It is easy to refer to the fatwas of jurists in case there is no difference of opinion among them. But in case of difference in fatwas or decrees, how should the conformity between laws and the Islamic precepts be decided? Various opinions have been expressed in response to this question, some considering the fatwa by guardianship of the Islamic jurist as the criterion while others also introducing fully qualified jurist, Guardian Council, commonly passed theories and the like. None of these opinions, however, is free from fault and all of them need expurgation and explanation that is impossible without reviewing such issues as ijtihad and taqlid (unquestioning acceptance of legal decisions by fully qualified jurist). Like many other works on Shia jurisprudence, Imam Khomeini’s book of Ijtihad and Taqlid has been authored without any reference to social and political issues, while the fundamentals of taqlid, that is totally a personal issue, has proved to be short of managing social issues in the majority of cases. Through an analytical method and library studies, this paper intends to first bring to light the positions of these ambiguities and then present a way for removing these problems. Adding martyred philosopher Sadr’s theory of public interests – after putting aside some theoretical flaws – to Imam Khomeini’s intellectual and practical procedures, can present a new basis for the highly debated issue of standard fatwa. The new theory may be titled “fatwa based on mandatory interests”.
