چکیده:
امضاء بخش مهمی از شخصیت و اعتبار حقوقی، تجاری و حتی هنری اشخاص است و برای اعتبار بخشیدن به اسناد بینالمللی وجود آن ضروری است. امضای یک سند مهمترین دلیل انتساب مفاد سند به ممضی و نشان دهنده پذیرش و قبول محتویات و مندرجات سند توسط متعاملینی است که ذیل آن را با رضایت امضاء کردهاند. به همین لحاظ امنیت در چنین فرایندی از اهمیت بسزایی برخوردار است و ورود این فرایند در فضای الکترونیکی و دیجیتال اهمیت این موضوع را دو چندان مینماید. به همین خاطر بدون وجود زیر ساختهای لازم امنیتی در فضای دیجیتال، امکان ارائه خدمات الکترونیکی وجود ندارد... نیاز به قانونگذاری در کنار فن آوریهای مذکور در جهت تامین این امنیت، یکی از موثرترین موارد تحقق این موضوع میباشد. لذا در این پژوهش در ابتدا بطور خلاصه و کلی به بررسی و تبیین امضای الکترونیکی در نظامات حقوقی مختلف میپردازیم و سپس سعی بر تبیین رویکردهای مختلف این نظامات، نسبت به موضوع امنیت امضاهای الکترونیکی مینماییم. تا در نهایت بتوان با بررسی برخی از قوانین کشورهای مختلف از جمله ایالات متحده امریکا، فرانسه و ایران، رویکردی متناسب با موضوع امنیت در فضای امضاهای الکترونیکی را تعیین نمود.
Signing is an important part of the personality and legal, commercial, and even artistic credentials of individuals, and it is necessary to validate international documents. Signing a document is the most important reason for the document's approval and acceptance of the content of the document by the Contracting Party. In this sense, security is so important in such a process, and the entry of this process in digital and electronic space make the importance of this issue twice. Therefore, without the necessary infrastructure in the digital environment, there is no possibility of providing electronic services. The need to legislate alongside these technologies to provide this security is one of the most effective ways of realizing this issue So, in this research, we first briefly and comprehensively examine and explain the electronic signatures in different legal systems, and then we examine the different approaches of these systems to the issue of security of electronic signatures. In a way that through studying some of the laws of different countries, including the United States, France and Iran it should be possible to determine an approach which is appropriate to the issue of security in the field of electronic signatures.
