چکیده:
قاعدهی نفی حرج از قواعد مسلّم و امتنانی است که با حکومت بر ادلهی اولیهی احکام، الزامِ انجام دادن تکالیفِ دشوار را برمیدارد. در حاکمیت قاعدهی نفی حرج بر واجبات تردیدی نیست؛ اما در مورد رابطهی آن با ادلهی اولیهی محرمات، اتفاق نظر وجود ندارد. ظاهر گفتار برخی فقیهان، حکومت قاعدهی یاد شده بر ادلهی محرمات است که بر اساس آن، مکلف میتواند با استناد به حرج، مرتکب محرمات شود. پذیرش این نظر، نتایجی ناپذیرفتنی در فقه و ناسازگار با اخلاق به دنبال خواهد داشت. در این نوشتار، ضمن بیان ادلهی باورمندان به این سخن، مبانی آن مورد نقد و ارزیابی قرار گرفته است. با توجه به عدم اطلاق دلیل لاحرج نسبت به امور عدمی و نیز با دقت به مفهوم ادلهی اضطرار، به نظر میرسد ادلهی محرمات، تخصصاً از گسترهی حاکمیت قاعدهی یاد شده بیروناند؛ و در صورت باقی ماندن تردید، اصل بر عدم رفع ادلهی محرمات توسط قاعدهی نفی حرج خواهد بود.
Negation of constriction rule (qā‘ida-yi naf-yi ḥaraj) is one of the indisputable and imtinānī (state or quality of being beholden) rules which, by ruling on the initial arguments, removes the obligation to perform difficult tasks. There is no doubt in the rule of ḥaraj over obligations, but no consensus has been reached on its relation to the basic arguments of prohibitions. Some jurists are seemingly declaring the rule of the above-mentioned provision on the arguments of prohibitions, according to which the obligated person can commit prohibitions based on constrictions (ḥaraj). This view will bring about unacceptable consequences in jurisprudence and is incompatible with morality. In this thesis, while stating the arguments of the proponents of this statement, its principles have been criticized and evaluated. Considering the non-application of the argument of no constriction (lā ḥaraj) to non-existent matters and also, taking into account the evidences of urgency, it seems that the arguments for prohibitions (muḥarramāt) are specifically beyond the scope of the mentioned rule. In case of doubt, the non-elimination of the arguments of prohibitions will be considered.
