چکیده:
اصطلاح «اخلاق حسنه» یک اصطلاح شناخته شدهی حقوقی است که عمدهی استعمال آن در حیطهی حقوق مدنی و آیین دادرسی مدنی میباشد؛ مثلاً در مادهی 975 قانون مدنی یا مادهی 6 قانون آیین دادرسی مدنی و ... . در عین حال در تعریف این اصطلاح میان دانشمندان حقوقی از جمله حقوقدانان متمرکز بر مباحث حقوق مدنی، اتحاد و اتفاق نظر وجود ندارد و تعاریف متعددی از این عبارت به چشم میخورد که ناشی از اختلاف نظر این اندیشمندان در مورد رابطهی این نهاد با نهاد نظم عمومی، ریشههای اخلاق حسنه و ... میباشد.
در مباحث حقوق جزا و قوانین جزایی جمهوری اسلامی ایران، اصطلاح «اخلاق حسنه» استعمال نشده و تنها در عنوان فصل هجدهم کتاب پنجم قانون مجازات اسلامی، عبارت «جرایم ضد عفت و اخلاق عمومی» بکار رفته است. سؤال این است که چرا علیرغم آنکه جرایم ارتکابی علیه حوزههای مختلف همچون اقتصاد، سیاست، فرهنگ و... در یک دستهبندی مشخص تحت عنوان جرایم علیه امنیت اقتصادی، امنیت سیاسی، امنیت فرهنگی و... جای میگیرند، جرایم علیه اخلاق دارای چنین وضعیتی نیستند؟ آیا نمیشود اصطلاح «امنیت اخلاقی» را در عرض عناوین پیشگفته وضع و استعمال نمود؟
بهنظر میرسد این امر ممکن و بلکه ضروری میباشد که اصطلاح «امنیت اخلاقی» تعریف و مصطلح گردد و این تعریف به عنوان تعریف پیشنهادی قابل ارائه میباشد: «احساس آرامش نسبت به هر گونه رفتار علیه ارزشهای اخلاقی جامعه از قبیل عفت و شرافت.»
The expression of “Good Deed” is a known legal expression utilizing generally in the realm of civil law and procedure; For instance, in the article 975 of civil law or article 6 of civil procedure, and etc. however, there is a conflict in defining this expression among lawyers, particularly civil ones; moreover, various definitions are observable, which originate from different opinions of these elites that are about the relation of this institution with public policy, roots of good deed, and so on. In criminal law and statutes of Islamic Republic of Iran, the expression of good deed was not utilized, and merely the phrase of “The Crimes against Decency and Public Morals” was posed in the title of the eighteenth section of the fifth chapter of Islamic Penal Code. The question is why in spite of distinguishable categories in different crimes toward economy, politic, culture, and etc. that put them under crimes against economic security, political security, cultural security, and etc. the same circumstance cannot be applied to crimes against morals? Is not it feasible to make and use the expression of “Moral Security” along with the mentioned titles? It sounds it is possible and essential to define and spread “Moral Security”, and the proposed definition is: “feeling convenient in regard with any behavior against moral values of society like decency and dignity.”
