چکیده:
جنایات ارتکابی میان نیروهای دولتی اوکراین و تجزیهطلبان طرفدار روسیه یکی از
مرگپارترین مخاصمات و درگیریهای جنگی در ده اخیر است. «هیئت نظارت ملل
متحد بر حقوق بشر در اوکراین» گزارشهایی را در خصوص افزایش آمار تلفات در اثر
این درگیریها و تصرف «کریمه» ارائه داده و مشارکت در درگیریهای شرق اوکراین را
بهعنوان نقض شدید قواعد آمرة حقوق بینلملل» شامل قتلعامء اذیت وآزاره بدرفتاری»
خشونت, بازداشت غیرقانونی و انواع دیگرآنچه اغلب نقض حقوق بشر فردی و جمعی
بهعنوان جنایت جنگی بودهء مطرح نموده است. از اینرو» مینوان صلاحیت قضایی
دیوان کیفری بینلطلی را در رسیدگی به جنایات مزبور احرا ز کرد؛ هرچند که جنایات
جنگی در بستر محاصمات مسلحانة بینلمللی و غیربینلمللی قابل ارتکابانده بهرغم
مسلحانة بینلمللی جرمنگاری شده, ارتکاب آنها بهطور کلی در چارچوب مخاصمات
مسلحانة غیربینلمللی بهمغابه جنایات جنگی قلمداد نمیشوند. این مقاله میکوشد تا
ضمن تایید ارتباط جنایات جنگی با مخاصمات مسلحانه در اوکراین که ابزاری برای
تشخیص معیارهای مفید برای دیوا ن کیفری بینالمللی است» مسئولیت کیفری مرتکبین
بالفعل و بالقوة اقدامهای دهشتاک در هر دو طرف مخاصمه را از حیث تناسب با
صلاحیت قضایی دیوان» مورد سنجش قرار دهد.
Jurisdiction of the International Criminal Court in the Investigation of War Crimes in Ukraine Peyman Namamian*- Manuchehr Tavassoli Naini** Abstract The atrocities committed by Ukrainian government forces and pro-Russian separatists are one of the deadliest in a decade. The United Nations Human Rights Monitoring Mission in Ukraine(UNHRMMU) reports on the escalation of casualties in the conflict and the occupation of Crimes, and its participation in the conflict in eastern Ukraine as a serious violation of the international law, including massacre, harassment. abuse, violence, unlawful detention, and other forms of what has often been described as individual and collective human rights violations as war crimes. Therefore, the jurisdiction of the International Criminal Court can be established in dealing with such crimes. Although war crimes can be committed in the context of international and non-international armed conflicts, despite the commonalities in nature, it is acknowledged that some war crimes are not criminalized in international armed conflicts. This article seeks to confirm the link between war crimes and armed conflict in Ukraine, which is a tool for identifying useful criteria for the International Criminal Court, and the criminal responsibility of actual and potential perpetrators of horrific acts on both sides of the conflict in accordance with the Court's jurisdiction to measure. گزارش دفتر دادستاني در مورد اقدام هاي بررسي مقـدماتي طـي سـال ٢٠١٦ اولين پرسش را در خصوص اين موضوع مطرح کرده است که «اقسـام مخاصـمات مسـلحانه در کريمه و در شرق اوکراين ، به چه نحوي بايد در ديـوان کيفـري بـين المللـي توصـيف و ارزيـابي شود؟»٤ اگرچه ، اوکراين عضو اساسنامۀ ديوان کيفري بين المللي نيست ، دو بيانيه را در ديوان بـه ثبت رسانده و بدين وسيله پذيرش صلاحيت تکميلي ديوان را در جرايم ارتکـابي از بيسـت ويکـم نوامبر ٢٠١٣ تا بيست ودوم فوريه ٢٠١٤(بيانيـه اول ) و از بيسـتم فوريـه بـه بعـد (بيانيـه دوم ) در 5 سرزمين اوکراين اعلام نموده است .
البتـه روسـيه رويکـرد منفـي سازمان ملل متحد به الحاق کريمه به روسيه را صراحتا به عنوان دليل خروج خود از ديوان بين المللي کيفري اعلام نکرده و در مقابل بهانه اي ديگر، يعني عملکرد نامناسب اين نهاد قضايي بين المللي ، را مطرح کرده است ؛ https://www.
