چکیده:
در سالهای اخیر شاهد رشد چشمگیر حضور بازیگران غیردولتی در عرصههای مختلف بینالمللی هستیم. شرکتهای تجاری یکی از این بازیگران غیردولتی هستند که در عرصههای مختلف بینالمللی بهدنبال حضور گسترده و کسب سود میباشند. علیرغم اینکه مخاصمات مسلحانه از یکسو برای غیرنظامیان و ساکنان مناطق جنگی فاجعهای خانمانسوز محسوب میشود، از سویی دیگر برای شرکتهای تجاری فعال در حوزههای نظامی و امنیتی، فرصتی برای حضور و کسب منافع بسیار زیاد فراهم میکند. پس از سقوط دولت صدام در عراق، شرکتهای تجاری آمریکایی که در عرصههای نظامی و امنیتی فعالیت داشتند، وارد عراق شدند و در طی سالهای ناآرام پس از جنگ، اقدام به فعالیت گسترده در حوزة نظامی و امنیتی کردند. یکی از این شرکتها، شرکت بلکواتر است. فعالیت این شرکت معطوف به حوزههای امنیتی است. در طول انجام مأموریت بلکواتر چند حادثة مهم (ازجمله حادثة میدان نسور و بحران وضعیت زندان ابوغریب) در عراق رخ داد. در پژوهش حاضر مسؤولیتهای کیفری ناشی از حوادث مزبور و وضعیت شخص حقوقی و اشخاص حقیقی درگیر در این حوادث از منظر حقوق بینالملل کیفری مورد بحث قرار گرفته است.
In recent years, we have witnessed a significant increase in the presence of non-governmental actors in various international arenas. Commercial companies are one of these non-governmental actors that are looking for a large presence and profit in various international arenas. While armed conflict is, on the one hand, a catastrophic catastrophe for civilians and residents of war zones, on the other hand, it provides an opportunity for military and security companies to be present and gain enormous benefits. After the fall of Saddam's government in Iraq, American companies operating in the military and security fields entered Iraq and during the turbulent years after the war, began to operate extensively in the military and security fields. One of these companies is Blackwater. The activity of this company is focused on security areas. Several important incidents (including the Nasour Square incident and the Abu Ghraib prison crisis) occurred in Iraq during the Blackwater mission. In the present study, the criminal responsibilities arising from these incidents and the situation of the legal person and natural persons involved in these incidents from the perspective of international criminal law have been discussed.
