چکیده:
تبیین فلسفی و ریشهیابی حقوق بشر در گفتمان حقوق بشر امری بسیار مهم و به غایت دشوار است. ادعای بیشتر فیلسوفان حقوق بشر آن است که حقوق بشر حقوق طبیعی بشرند. در نتیجه، خاستگاه این حقوق باید طبیعت انسان باشند. استدلال کردن بر این مطلب که ریشه هرحقی از حقوق بشر در کجای طبیعت انسان قرار دارد، امری بدیع است. نفس آدمی به عنوان طبیعت انسان از سه مرتبه گیاهی (نباتی)، حیوانی و ناطقه تشکیل شده است. حقوق طبیعی بشر مقتضای این مراتب سهگانه در راستای حرکت انسان به سوی کمال نهایی خود، یعنی مقام انسان کامل است. بنابراین، حقوق بشر به سه دسته حقوق گیاهی، حقوق حیوانی و حقوق عقلانی تقسیم میشوند.موضوع این مقاله «فلسفه حقوق طبیعی گیاهی بشر» است. این نگارش درصدد پاسخگفتن به این پرسش است: چرا بشر حقوق گیاهی دارد؟ به سخن دیگر، ریشههای حقوق گیاهی بشر در ذات انسان کدامند؟ در این پژوهش سعی شده است به کمک بازخوانی بخشی از نظریه اسلامی قانون طبیعی دلیل فلسفی وجود هریک از حقهای طبیعی گیاهی بشر بیان شود. این امر نوآوری این مقاله است. حقوق گیاهی بشر که در منشوری به نام منشور حق حیات گیاهی بشر وجود دارند، مشتمل بر 25 حق هستند. ارکان این حقها پنج حق اولی بوده که عبارتند از: حق تغذیه سالم (امنیت غذایی)، حق تنفس در هوای پاک، حق بر سلامت، حق بهداشت (و درمان) و حق فرزندآوری. 20 حق دیگر که حقوق ثانوی هستند از این پنج حق اولی بهدست میآیند. روش پژوهش در این نگارش، روش عقلی است.
Human rights etymology is so important and at most difficult in human rights discourse. Most philosophers of human rights claim that they are natural rights. Therefore, human nature must be their resource. This is innovative to give argument to indicate where the base of each right of human rights in human nature is. Human soul as human nature is of three levels: vegetative, animal and rational levels. Natural human rights are effects of those levels in the direction of human movement to the final perfection, i.e. the stage of perfect human being. Thus, natural human rights are divided into three classes: vegetative, animal and rational rights.This writing aims at answering to this question: why does the human have vegetative rights? In other words, what are the roots of vegetative rights in human nature? In this research activity, it is prompted to be spelt out the philosophical reason of each natural vegetative right of humans by revising some part of the Islamic theory of natural law. This is the innovation of this paper. Vegetative human rights, which are included in the collection of the right to vegetative life of humans, are 25 rights. The bases of those rights are five basic rights which are: safely nutrition right (nutrition immunity), the right to breathing in fresh air, the right to health, the right to hygiene (and cure) and the reproduction right. Other 20 rights which are secondary, are derived from these primary rights. The research method is rational in this writing.
