چکیده:
ماهیت مفاهیم حقوق بشر و حقوق شهروندی و رابطه میان آنها همواره محل بحث و چالش بوده است. مفهوم حقوق شهروندی بر اساس عوامل وجودی و روند تاریخی به دو دسته حقوق شهروندی سنتی و حقوق شهروندی مدرن قابل تقسیم است. بر همین مبنا هم حقوق بشر به دو دسته حقوق بشر طبیعی و قراردادی تقسیم میشود. همخوانی هایی در عوامل وجودی هر کدام از آنها منجر به شکلگیری رابطه میان آنها شد. در ابتدا، رابطه حقوق شهروند سنتی با حقوق بشر قراردادی شکل گرفت و در ادامه و به مقتضای زندگی مدرن بشری، رابطه حقوق شهروندی مدرن با حقوق بشر طبیعی پدید آمد. قانون اساسی در قالب اصول مکانیسمی و جوهری حاوی هر دوی این روابط میباشد به طوری که رابطه حقوق شهروندی مدرن و حقوق حقوق بشر طبیعی در اصول جوهری و رابطه حقوق شهروندی سنتی با حقوق بشر قراردادی در اصول مکانیسمی درج میشود. قانون اساسی جمهوری اسلامی ایران هم نسبت به این قاعده پایبند میباشد و اصول جوهری خود را به مفاهیم حقوق بشر طبیعی و حقوق شهروند مدرن و رابطه میان آنها اختصاص داده و در اصول مکانیسمی هم به مفاهیم شهروندی سنتی و حقوق بشر قراردادی و رابطه میان آنها اشاره کرده است.

The Constitution of the Islamic Republic of Iran adheres to this rule and devotes its essential principles to the concepts of natural human rights and modern citizen rights and the relationship between them, and in the principles of mechanism to the concepts of traditional citizenship and conventional human rights and the relationship between They pointed out.
