چکیده:
زمینه و هدف:جرایمدولتی، هنجارهایی بهظاهرقانونی هستند که آشکارا سببنقض حقوق بنیادین افرادمیشود وناکارآمدیِ قوانیندر پیشگیری ازظهور آنها، وجوبجرمانگاری چنین رفتارهایی راایجاب مینماید. امروزه بهرسمیت شناختنمفهوم نوظهورجرایم دولتی، ضرورتی اجتنابناپذیر برای حفظ حقوق بنیادین بشر، از جمله حق بر سلامت شهروندان است؛ لکن محظوراتی مانع تحقق آن و فارغدانستن دولتها ازمسئولیتکیفری درقبال ارتکابرفتارهای غیرقانونی شده است. رفتارهایی ازجمله نقض گستردۀ حق برسلامت شهروندان،اعمال تبعیضناروا درعرضۀ خدمات درمانی شایسته را میتوان ازجرایم غیرقانونیِ سلامتستیزدولتی تعبیرنمود،درحالی که حقسلامت شهروندان در اسناد بینالمللی و حقوق داخلی دولتهامورد تأکیدقرارگرفته ودولتها متعهد به تأمین سلامت شهروندان شدهاند.لکن با پیدایش کووید-19، بحرانی در حوزۀ تأمین سلامت شهروندان، گریبانگیردولتهاشده ومدیریت این بحران چالشیبیسابقه برای دولتها رقمزده است. ازاینرو مقالهپیشرو درصدد ارزیابی اقدامات دولتوقت ایران دربحران یادشده،در قالب جرایمدولتی میباشد.
مواد و روشها:روش تحقیق دراین مقاله بهصورت توصیفی-تحلیلی، وروش جمعآوری اطلاعات بهصورت کتابخانهای، بامراجعه به اسناد، کتب ومقالات انجام شده است.
ملاحظات اخلاقی:درمقالۀ پیشرو، اصالت متون، صداقت و امانتداری رعایت شده است.
یافتهها: یافتههای تحقیق مبین بدمدیریتیهایی است که میتواند مصداق بارز جرایم دولتی قلمداد شود.رفتارهایی که هرچند علیرغم ضررهای جبرانناپذیر آن صریحاً جرمانگاری نشده است، لکن استنادبه قانون مانع از مسئولیتکیفری دولت بهدلیل ارتکاب رفتارهایغیرقانونی نیست.
نتیجهگیری:امروزه نقش دولتها در حمایت از حقوق بنیادین شهروندان در ظهور بحرانهای فراگیرآشکاراست و ظهور کووید-19 را میتوان یکی از مهمترین بحرانها دانست. اما در راستای مدیریت بحران یاد شده، اعمال سیاستگذاریهای ناکارآمد، قصور در عرضۀ خدماتدرمانی شایسته، رفتارهایی است که علیرغم نقض آشکار حق سلامت شهروندان، قابلیت اضرار عمومی آن برکسیپنهان نیست، ازاینرو گزافگویی نیست که مقتولانکووید-19 را ازبزهدیدگانجرایم دولتی یادکنیم.
Background andAim:Governmentcrimes areostensiblylegal norms thatclearlyviolate thefundamental rights ofindividuals,and theineffectivenessof thelaw inpreventingtheiroccurrence necessitatesthe criminalization of such behaviors. Today, recognition of the emerging concept of state crime is an inevitable necessityfor theprotection offundamental humanrights,including therighttohealthof citizens;However, restrictions have prevented it from being realized andgovernmentshavebeenexempted fromcriminal liability for illegal behavior. Behaviorssuch aswidespread violations of citizens 'right to health,unfair discrimination in the provision of adequate health carecan beinterpreted asillegal governmenthealth crimes,while citizens' right to health is enshrinedin internationalinstrumentsand domesticlaw.Emphasishas beenplacedon governmentscommitted to ensuringthe health ofcitizens.Butwiththe adventof Covid-19,a crisis inthe health of citizenshas grippedgovernments,andmanaging thiscrisis hasposedanunprecedentedchallengefor governments.Therefore,the leading article seeks to evaluatethe actions ofthe then Iranian government in the crisis in the formof governmentcrimes.
Materials andMethods:Theresearch method in thisarticle is descriptiveanalytical,and the method of data collection is library, with reference to documents,books and articles.
Ethical considerations:In the present article,the originality of the texts, honesty and fidelity have been observed.
Findings:Thefindingsof thestudyindicatemismanagementthatcan beconsideredas aclear exampleof government crimes. Behaviors that, although notexplicitly criminalizeddespite theirirreparable harm,do not invoke the lawto prevent thegovernment from being heldcriminallyliable forcommitting illegalacts.
Conclusion:Today,theroleof governments iprotecting thefundamental rights ofcitizens in theemergence of pervasive crises is obvious and the emergence of Covid-19can beconsidered oneof themost important crises. But in order to manage this crisis,the implementation ofinefficient policies, failure to provide adequate health care, are behaviors that,despitethe obvious violation of citizens' right to health, its potential for public harm is not hidden from anyone,so it is an exaggeration.It is not as if we mention the victims of Covid-19 asvictimsof statecrimes.
