في دين الاسلام؛ يعد الطلاق من حقوق الرجل فلا يستطيع أحد إسقاطه؛ والزوجة تستطيع أن تأخذ الوكالة من الزوج وقبولما للوكالة تجعل نفسها وكيلة في عملية الطلاق وتستطيع أن توكل شخصا آخر في ذلك لکن هذه الوكالة في الحقيقة بمثابة نيابة من الزوج وهي عقد جائز و قابل للفسخ إلا أنه على أساس عقد لازم كعقد الصلح يستطيع الزوج أن يعزل ويسقط وكالة الوكيل. إذن هذه الوكالة تعد نيابة من الزوج ومع جنون أم موت الرجل تسقط لكن الزوجة بأخذها التشويض للوكالة من الزوج ترتفع هذه النقيصة. هذه الورقة البحثية تتعهد تبيين موضوع التوكيل والتفويض وأقسامها و التفاوت بينهما وسنجیب على ما يلي هل تفويض الطلاق إلى الزوجة أم إلى شخص ثالث جائز؟ و هل تفویض الوكالة في الطلاق من الزوجة إلى شخص آخر جائز؟ وهل له آثار تفويض الطلاق؟
In Islam religion divorce is
man’s right and is one of his
virtues and therefore he can’t
waive it. By getting a power of
attorney from her husband, wife
can make herself proxy in
divorce. And by delegating
another, she can cede this power
of attorney to someone else.
However this attorney is in fact
the representation and delegation
of husband and is a revocable
contract and is terminable unless
based on an irrevocable contract
like contract of settlement,
husband waive from lawyer
uninstallation’s right. Yet still
this attorney is kind of
representation and delegation
from husband and will be gone
by insanity or death of husband.
Yet wife can resolve this
Disadvantage by getting
Delegating of Attorney. In this

answer this question that is
