چکیده:
پژوهش حاضر باهدف تبیین و تحدید مسئولیت مادر در مقابل اعمال زیانآور کودک در فضای سایبر، بهروش توصیفی از نوع اسنادی انجام و اطلاعات پژوهش بابررسی و مطالعه منابع مکتوب در موضوع مربوطه جمعآوری و تحلیل شد. با بررسیهای انجام شده در پژوهشهای پیشین مشخص شد تاکنون مطالعهایی با موضوع پژوهش حاضر انجام نشده است. یافتههای پژوهش حاضر نشان داد که مطابق اصول فقهی- حقوقی، مادر در جایگاه یکی از والدین، واجد حق و تکلیف حضانت کودک است. رعایت این تکلیف محدود به محیط فیزیکی نیست و در فضای سایبر نیز باید اجرا شود؛ چراکه بهموجب ماده 7 قانون مسئولیت مدنی، ممکن است مادر در قبال اعمال زیانبار کودک، مسئول شود. با لحاظ شرایط ویژه مادر ازجمله نداشتن ولایت قانونی بر کودک، تلاش وی برای امرار معاش (در فرض نبود همسر)، دانش کمتر برخی بانوان از فضای سایبر در قیاس با آقایان و نیز شرایط و ویژگیهای خاص این فضا، بهنظر میرسد که تعدیل مسئولیت مادر در قبال اعمال زیانبار کودک در فضای سایبر منطقی و لازم است. همچنین نتایج پژوهش نشان داد که حکم به مسئولیت بهمیزان تقصیر مادر در فرض همراهی همسر با او و نیز لحاظ شرایط خاص مادر و فضای سایبر، در احراز تقصیر مادر، با اصول و قواعد فقهی و حقوقی سازگار بوده و قابل پیشنهاد است.
The present research tried to explain and limit maternal civil liability for harmful acts of the child in cyberspace with a descriptive-documentary method. The data were gathered via reviewing the related written sources. Analyzing the previous studies indicated that there is no study with the same topic. The findings showed, according to the jurisprudential-legal principles, the mother in the position of one of the parents has the right and duty of custody of the child. This duty is not limited to the physical environment, it also consists of the cyberspace; because, based on Article 7 of the Civil Liability Law, the mother may become liable for harmful acts of the child. It seems that the adjustment of maternal liability for harmful acts of the child in the cyberspace is logical and necessary, due to maternal special conditions, such as lack of legal guardianship over the child, making a living (in the absence of the spouse), less knowledge of the cyberspace in comparison with men, and the particular conditions of the cyberspace. In addition, the ruling on the maternal liability to the extent of her negligence, in assuming that her husband is accompanied by her, as well as her special conditions and the cyberspace, is consistent with the jurisprudential-legal principles and can be recommended.
