چکیده:
تغذیه با شیر مادر یکی از مهمترین ضروریات، در فرایندِ سلامت و رشد و نمو کودکان است.در اغلب کشورهای جهان با توجه به توصیههای سازمان بهداشت جهانی و حساسیتهای موجود در زمینهی تغذیهی نوزادان با شیر مادر، عرضه و ارائهی شیرخشک با محدویتهای جدی مواجه میباشد. از سوی دیگر با توجه به وجود بحرانهای اجتماعی، اقتصادی و امنیتی در نقاط مختلف دنیا، جهان با چالشِ افزایش تعداد آواراگان و پناهندگان، مواجه است. با هدف اسکان موقت آوارگان و کمک به آنها برخی از کشورهای جهان، اردوگاههای موقتی را در نقاط مرزی خود برپا نمودهاند. تعداد زیادی از زنان و کودکان در این اردوگاهها اسکان یافتهاند. با توجه به ارائهی شیرخشک در این اردوگاهها در قالب کمکهای بشردوستانه، وضعیت تغذیهی نوزادان و کودکان شیرخواره و همچنین مسائل مربوط به سلامت و رشد نموشان، به یک نگرانیِ حقوق بشری تبدیل شده است. در این راستا، پژوهش حاضر با توسل به شیوهی تحلیلی ـ توصیفی به دنبال یافتن پاسخی مناسب برای دو پرسش است. اول، اینکه آیا، طبق قواعد بین المللی حقوق بشری، حقی به نام حق بر بهرهمند شدن از شیر مادر وجود دارد؟ اگر چنین حقی وجود دارد، با توجه به شرایط اضطراری موجود در اردوگاههای پناهندگان، چگونه میتوان از عهدهی اجرا و تأمینِ چنین حقی برآمد؟ به نظر میرسد در قالب برخی از اسناد حقوق بشری ، بحث حقِ بر شیر مادر به نوعی مطرح شده و تأمین این حق، تعهدی است که دولتهای برپاکنندهی اردوگاه، بر عهده دارند.
Breastfeeding, also known as natural nutrition, is recognized as a vital factor in the development and health of children. in most countries of the world, according to the recommendations of the World Health Organization and the existing sensitivities in the field of breastfeeding infants, the supply of formula milk is facing serious limitations. On the other hand, due to social, economic and security crises, the world is facing the challenge of increasing the number of displaced persons and refugees. Some countries around the world have set up temporary camps in their border areas with the aim of providing temporary accommodation and assistance to refugees. Large numbers of women and children are housed in these camps. Due to the provision of formula milk in these camps in the form of humanitarian aid, the nutritional status of infants and toddlers, as well as issues related to the health and development of the sample, has become a human rights concern. In this regard, the present study seeks to find a suitable answer to two questions by using analytical-descriptive method. First, is there a right under international human rights law about the right to breastfeeding? Second, if there is such a right, given the emergency situation in the refugee camps, how can such a right be enforced and secured? In some human rights documents, the issue of the right to breast milk seems to have been raised . The exercise of this right is an obligation of the governments establishing the camp.
