چکیده:
به علت به صرفه نبودن طرح دعوا در دادگاه ملی از جهت گرانی هزینه دادرسی، وقت گیر بودن و ناچیز بودن مبلغ خسارت، مسافران پروازهای هوایی در بسیاری مواقع علیه متصدیان حملونقل به سبب خسارات ناشی از تأخیر، لغو و حتی جراحت بدنی، طرح دعوا نمی کنند که البته منجر به قهر مسافران با این صنعت شده و با حقوق مصرف کننده هم در تعارض است. بنابراین سازوکاری لازم است تا از این افراد حمایت شود. در کشورهای اروپایی این حمایت و سازوکار از طریق اتاق های داوری حاصل شده است، هرچند براساس ماده 34 کنوانسیون مونترال همچون سند مادر، کنوانسیون ورشو (ماده 32)، داوری به عنوان شیوهای برای حل و فصل دعاوی ناشی از مسئولیت متصدی حمل کالا انحصارا مورد تأیید قرار گرفت. از اینرو پرسش مهم آن است که آیا دعاوی مربوط به حمل مسافر هم قابلیتارجاع به داوری را دارد؟ در این راستا براساس گرایش به داوریپذیری و با توجه به وارسی گفتگوهای مقدماتی، قلمرو موضوعی آن را علاوه بر حمل کالا، به حمل مسافر توسعه داده و اثبات میشود در حقوق ایران از این جهت منعی وجود ندارد؛ علیالخصوص که ترک دعوا یا رجوع به سیستم قضایی ایران که در حلوفصل این نوع دعاوی ناتوان میباشد، مطلوب نیست. از اینرو با پذیرش اصل داوریپذیری این دسته از دعاوی، با اقتباس از پیشرفتهای اروپاییان مدلی جهت تأسیس اتاق داوری برای حلوفصل دعاوی مربوط به مسئولیت متصدیان حملونقل در مقابل مسافران از جهت ساختار و سازوکار (میزان هزینه، زبان رسیدگی، مدت رسیدگی و ..) در ایران ارائه میشود.

The important question is arisen, then, is whether passenger claims can also be referred to arbitration. In this regard, based on the tendency to arbitration and according to the examination of preliminary talks, in addition to the carriage of cargo, to the carriage of passengers is developed and it is proved that there is no prohibition in Iranian law in this regard; In particular, it is not desirable to abandon litigation or refer to the Iranian judicial system, which is incapable of resolving such litigation. Therefore, by accepting the principle of arbitrability of this category of lawsuits, based on the progress of Europeans
