چکیده:
چکیده
سابقه و هدف: امروزه خرید و فروش داروهای دولتی خارج از سیتم نظارتی به صورت غیر علنی در جامعه خود نمایی می نماید که منتج به اختلال نظام توزیع دارویی، آسیب و ضرر به بیمار می گردد. در این راستا می طلبد که در جستجوی عامل بازدارنده درونی و بیرونی از اعمال چنین عملکردی گامی برداشته شود، بنابراین در این مقاله به دنبال تبیین حکم فقهی خرید و فروش داروهای دولتی خارج از سیستم نظارتی می باشد تا حکم الهی در مورد آن تخریج و استنباط گردد چه بسا در پرتوی قوانین الهی معاملات شرعی تنویر پذیرد و خود مانعی از ادامه آن گردد.
روش: در این مقاله با روش توصیفی – تحلیلی و با استناد به کتاب و سنت و عقل به استخراج و استنباط حکم خرید و فروش داروهای دولتی خارج از سیستم نظارتی پرداخته است.
یافته ها: با تتبع در آرای چندی از فقهای معاصر حکم به عدم جواز خرید و فروش داروهای دولتی خارج از سیستم نظارتی با استناد به آیات و روایات و عقل از اتقان برخوردار می باشد و با استناد به آیات 29 و 59نساء و 2 مائده و سنت و قاعده وجوب حفظ نظام و حرمت اخلال به نظام، وجوب عدل و انصاف، لاضرر، نفی عسر و حرج و قاعده حرمت اعانه بر اثم، جایز نمی باشد.
نتیجه گیری : نتیجه گویای این است که خرید و فروش داروهای دولتی خارج از سیتم نظارتی با توجه به مبانی فقه شیعه از آن جا که بر خلاف مقرّرات جمهوری اسلامی و مصداق اکل مال به باطل است و نیز اخلال به نظام را در پی دارد و با انصاف و عدل سازگار نیست و یا منشأ ضرر و عسر می باشد، جایز نیست.
Background and purpose: Nowadays, the sale and purchase of government drugs outside the regulatory system is manifested in private in society, which leads to disruption of the drug distribution system and harm to the patient. In this regard, it’s demanded to take a step in searching an internal and external deterrent to such action. So this article seeks to explain the jurisprudential ruling on it so that the divine ruling be on its extraction and inference; it’s possible that in the light of the divine laws, sharia transactions will be enlightened and prevent it from continuing.
Method: In this article, with a descriptive-analytical method and with reference to books, traditions and reason, the sentence of buying and selling government drugs outside the regulatory system is extracted and inferred.
Findings: Following the opinions of some contemporary jurists, the ruling on prohibiting the purchase and sale of government drugs outside the supervisory system is based on verses, hadiths, and reason. It is invoked according to verses 29 and 59 of Nisa and 2 Ma'idah and Sunnah and the rule of the obligation to maintain order and sanctity to disturb the system, the obligation of justice and fairness, no harm, the denial of hardship and the rule of sanctity of donation on sin is not permissible.
Conclusion: The result shows that the purchase and sale of government drugs outside the regulatory system according to the principles of Shiite jurisprudence, since it is contrary to the regulations of the Islamic Republic and an example of the property is void and it also leads to disruption of the system and isn’t compatible with fairness and justice or is the source of harm and hardship, is not permissible.
