چکیده:
دکترین «اقدام براساس هدف مشترک» نوعی خاص از مسئولیت کیفری است که در جریان دادرسیهای دادگاه کیفری بینالمللی یوگسلاوی سابق ایجاد شد. این مفهوم، همۀ افراد مداخلهکننده در یک گروه را که برای تحقق و پیشبرد یک هدف مجرمانۀ مشترک و توافقشده تلاش میکنند، بهیکمیزان و همسان مباشر اصلی جرم مسئول میداند. با وجود بهرسمیتشناختن این نوع خاص از مسئولیت، اقدام براساس هدف مشترک، با مسائل مهمی در رکن مادی و روانی مواجه است؛ ازجمله اینکه چگونه میتوان از منظر کیفری بر فردی که در عنصر مادی جرم هیچگونه دخالتی نداشته و فراتر از آن، فاقد وضعیت ذهنی و روانی مقتضی نیز بوده، مسئولیتی همپایۀ مباشر تحمیل کرد و او را مجازات نمود. بهعلاوه، این امر نیز حائز اهمیت است که آیا این نوع مسئولیت تنها به جرائم بینالمللی محدود میگردد یا در جرائم داخلی و نظام حقوقی ایران نیز با اقبال روبهرو شده است. ازاینرو، پژوهش حاضر با رویکردی توصیفیتحلیلی درصدد تبیین مسائل فوق بوده و درنهایت چنین نتیجهگیری مینماید که بهرغم تعارض ظاهری دکترین «اقدام براساس هدف مشترک» با اصول حقوق کیفری، توجیه این نوع مسئولیت امکانپذیر بوده و در حقوق ایران با جرائمی همچون بغی، تاحدودی میتواند تطبیق یابد.
AbstractThe "Joint Criminal Enterprise"(JCE) doctrine is a special form of liability that innovates in the International Criminal Court for the Former Yugoslavia (ICTY). According to this form of liability, all the members of a criminal group that try to reach a criminal enterprise, have the same liability as to the accomplice. However, the JCE has faced different legal dilemmas since its introduction in the ICTY Judgments both in respect of actus reus and mens rea of the persons who are found liable based on JCE. How a court can convict a person who doesn’t commit the actus reus of a crime like a perpetrator and more important how it can convict a person who has no actus reus and mens rea related to committed crime, at all. This paper will scrutinize these issues and if this kind of liability recognizes in Iranian criminal law. Finally, this paper concludes that this form of liability has no conflict with criminal law principles and Iranian criminal law recognizes JCE in some crimes such as Baghy
