چکیده:
إذا کانت العلاقة الجنسیة بین الرجل و المرأة ضرورة جسدیة ونفسیة و اجتماعیة حفظا للنسل من الاندثار، فإن هذه العلاقة أوجد لها الشارع قبل المشرع إطارا تمارس فی نطاقه، إذ أن أی خروج عن هذا النطاق یزج بطرفی العلاقة إلی دائرة الممنوع شرعا وقانونا، هذا النطاق هو مؤسسة الزواج، و حتی داخل هذه المؤسسة یجب سیادة المودة و الرضا فی الممارسة الجنسیة. إلا أن ما یؤاخذ علی التشریع المغربی و معه الفقه أنه ینفی قیام أی جریمة فی حالة إکراه الزوج للزوجة علی المعاشرة الجنسیة ولا یقرر قیام الجریمة و هی هنا جریمة الاغتصاب إلا فی حالة انعدام العلاقة الزوجیة و إکراه المرأة مادیا أو معنویا علی الاتصال الجنسی من طرف الرجل، بل إن هذه الجریمة تقوم متی کان هناک إکراه علی الاتصال الجنسی بین الخلیل و الخلیلة رغم تواجدهما فی نطاق علاقة غیر شرعیة. أمام هذه المفارقة القانونیة، سنحاول فی هذا المقال الوقوف عند جریمة الاغتصاب نظرا لما ترتبه من أضرار مادیة جسدیة و معنویة فی حق الضحیة، و کذلک من أضرار اجتماعیة فی حق المجتمع و ذلک من خلال مناقشة أرکان هذه الجریمة و تقییم مدی نجاعة العقوبة المقررة لها بنص التشریع فی تحقیق الردع الخاص والردع العام انطلاقا من العمل القضائی فی الموضوع مع بیان مدی وجوب تدخل المشرع بهذا الخصوص.
If the sexual relationship between a man and a woman is a physical, psychological, and social necessity in
order to save the offspring from extinction, then this relationship has been created by the legislator before
the legislator, a framework to be practiced within its scope, because any deviation from this scope brings
the two parties of the relationship into the circle of what Sharia and law prohibit.
This scope is the institution of marriage, and even within this institution, affection and consent must prevail
in sexual practice.
However, what is to be blamed on the Moroccan legislation - and with it the jurisprudence - is that it denies
the occurrence of any crime in the case of the husband's coercion of the wife to have sexual intercourse
and does not determine the crime - which here is the crime of rape - except in the case of the absence of
the marital relationship and the financial or moral coercion of the woman to communicate Sexual
intercourse on the part of the man.
The institution of marriage falls within this scope, and even within this institution, affection and consent
must prevail in sexual practice.
However, the Moroccan legislation - and thus the jurisprudence - is to blame for denying the occurrence of
any crime in the case of the husband's coercion of the wife to have sexual intercourse and does not
determine the crime - which in this case is the crime of rape - except in the absence of the marital
relationship and the man's financial or moral coercion of the woman to communicate Sexual intercourse.
This crime occurs whenever there is compulsion to have sexual intercourse between the boyfriend and the
concubine, even if they are in an illegal relationship.
In the face of this legal paradox, we will attempt to stand at the crime of rape - given the material and moral
harm it causes the victim, as well as the social harm it causes society - by discussing the elements of this
crime and evaluating the efficacy of the prescribed punishment in this article. It contains the text of
legislation based on judicial work to achieve private and general deterrence, as well as an indication of the
extent to which the legislature must intervene in this regard.
