چکیده:
الأصل أن یمارس البرلمان الوظیفة التشریعیة بمفرده-أی سن القواعد القانونیة فی مختلف المجالات-ویقتصر دور السلطة التنفیذیة علی تنفیذ القوانین غیر أن هذه القاعدة قد تغیرت منذ صدور دستور الجمهوریة الخامسة فی فرنسا، حیث أصبح بإمکان البرلمان أن یفوض للحکومة ممارسة وظیفته التشریعیة، لتتولی تنظیم موضوعات معینة خلال فترة محددة علی اساس انها تتطلب التدخل السریع ولما کان ذلک فإن تفویض الإختصاص التشریعی ومایترتب علیه من قرارت تصدرها السلطة التنفیذیة لا فی غیبة البرلمان کلوائح الضرورة، بل تصدرها والبرلمان منعقد، کل ذلک یشکل خطورة بالغة لأن تنازل البرلمان عن جزء من إختصاصه التشریعی هو بمثابة التخاذل والتنحی، الأمر الذی لایتماشی ومبدأ الفصل بین السلطات، ورغم ذلک فإن معظم الدساتیر المعاصرة قد أخذت بهذا النوع من اللوائح، کما أخذت به دساتیر دول المغرب العربی ومنها موریتانیا.
Originally, Parliament exercises legislative function alone - that is, enacting legal rules in various fields - and
the role of the executive branch is limited to the implementation of laws.
However, this rule has changed since the promulgation of the Constitution of the Fifth Republic of France,
where Parliament can delegate to the government to exercise its legislative function, to regulate certain
topics during a specific period on the basis that they require rapid intervention.
Since this is the delegation of legislative competence and the consequent decisions issued by the executive
branch, not in the absence of the parliament like the regulations of necessity, but by the parliament
presence, all of which pose a great danger because the relinquishment of part of its legislative competence
by Parliament is tantamount to inaction and stepping down, This is not in line with the principle of separation
of powers, yet most contemporary constitutions have been adopted with this type of regulations, as have
been adopted by the constitutions of the Arab Maghreb countries, including Mauritania.
