چکیده:
اگرچه طرح های عمومی و عمرانی با هدف افزایش سطح رفاه شهروندان تهیه و اجرا میشوند؛ اما بسته به نوع پروژه، نمیتوان آثار منفی آنها علی الخصوص بر املاک همجوار و ورود خسارت به برخی از شهروندان را نادیده گرفت. چنانچه ورود خساراتی از قبیل کاهش قیمت املاک مجاور طرح به دلیل افزایش آلودگی صوتی ، زیست محیطی و محدودیت اعمال حقوق مالکانه افراد پس از اجرای طرح مسلم بوده و رابطه سببیت نیز احراز شود، برخی از مهم ترین ارکان مسئولیت مجری طرح محقق شده است. اما حکم مواد 1 و 11 قانون مسئولیت مدنی در خصوص ضرورت احراز عنصر تقصیر و مبانی نظیر حفظ منافع و مصالح عامه در اجرای انواع طرح ها و پیچیدگی ماهیت این خسارات، موانع جدی جهت مطالبه خسارت ایجاد میکند . در این نوشتار در پی پاسخ به این پرسش هستیم که آیا به رغم خلاء قانونی و موانع موجود، میتوان مجری یک پروژهی عام المنفعه را مسئول جبران خسارات حاصله به املاک همجوار دانست؟ در صورت پاسخ مثبت، استفاده از کدام مبنا برای جبران خسارت توسط دولت قابل توجیه است؟ در نظام حقوقی ایران ظرفیت های قانونی و شرعی لازم جهت الزام صاحبان سرمایه و قدرت به جبران این خسارات وجود دارد. در این راه علاوه بر نظریه تقصیر ، نظریه تساوی شهروندان در برابر هزینه های عمومی و درونی کردن هزینه های خارجی نیز میتواند به عنوان مبانی مسئولیت مدنی در نیل به تحقق عدالت اجتماعی موثر باشد.
