معاملات در بورس، یکی از چرخههای اقتصادی کشور بوده که با جذب نقدینگی موجود در جامعه، ضمن ممانعت از تورم، آن را در جهت تولید ارزشافزوده به کار میگیرد. اخیراً روش معامله در بورس، به نوع الکترونیکی تغییر یافته است و موجب ترغیب مردم جهت سرمایه گذاری در بورس شده است و البته حضور گسترده مردم در بازار سرمایه در صورتی که از طریق کانالهای صحیح صورت گیرد و منابع حاصل شده در مسیری درست هدایت شود، میتواند رخدادی فرخنده برای اقتصاد کشور محسوب شود. از سوی دیگر ضمن آگاهی از مخاطراتی که استقبال گسترده مردم به این بازار میتواند داشتهباشد، لازم است تمهیداتی اندیشیده شود که این پتانسیل بزرگ هدر نرفته و منابع به سمت بخشهای مولد و حائز شرایط هدایت گردد و سرمایه مردم به یغما نرود. در این پژوهش، سرمایه گذاری الکترونیکی و نوسانات در بورس اوراق بهادار از منظر فقهی، به روش تحلیلی ـ توصیفی بررسیشده است.بدین ترتیب که از دیدگاه فقهی، معاملات الکترونیکی و به تبع آن سرمایه گذاری الکترونیکی در بورس، بهموجب آیات، روایات و قواعد فقهی لاضرر، اباحه، بنای عقلاء، تراضی، لزوم، صحت، منع غرر و منع تدلیس، هنگامی مشروع و نافذ است که بر مبنای رضایت طرفین بوده و در غیر اینصورت موجب رکود بازار سرمایه و اتلاف سرمایه مردم خواهد شد که طبیعتا از نظر فقهی پذیرفته نیست.
