چکیده:
مبانی معاهدات بین الملل از دو اصل ثبات و تغییر برخوردار میباشند، چراکه از سویی تحولات بین الملل و لزوم توجه به مقتضیات زمان و مکان، موجب انعقاد معاهدات جدید گردیده و از طرفی این امر نباید باعث تهدید ثبات، امنیت و استمرار معاهدات گردد، زیرا در اغلب نظامهای حقوقی اصل ثبات و امنیت، پذیرفته شده است و قاعده لزوم وفا به معاهدات تبلور عنصر ثبات و استمرار آن است. با این وجود، عدم رعایت اصل ثبات در شرایط خاصی مجاز دانسته شده است چنانچه تغییر بنیادین، تعادل معاهدهای اساساً بر هم زند، در این صورت فسخ و یا تعدیل معاهده، به جای حکم اولیه که التزام به مفاد آن است، میگردد. این اصل بهترین راهحل جمع بین دو عنصر ثبات و تغییر است در واقع استثنایی بر اصل الزامی بودن معاهدات می باشد.در صورت بروز حوادث غیر مترقبه و تغییر بنیادین، با سه مبنای نظریه غبن، تئوری تفسیر اراده متعاملین و قاعده عسر و حرج، با بررسی دیدگاه امام خمینی می-توان این قاعده را در موارد استثنائی در حقوق ایران پذیرفت.این نوشتار به روش توصیفی تحلیلی با ابزار کتابخانهای و تجزیه و تحلیل مضامین فیش برداری شده و استنتاج گزارههای فقهی حقوقی، صورت پذیرفته است.

In fact, it is an exception to the principle of binding treaties.In case of unexpected events and fundamental change, with three bases of the theory of fraud, the rule of hardship and the theory of interpretation of the will of the interlocutors, by examining the view of Imam Khomeini, this rule can be accepted in exceptional cases in Iranian law.This article has been done in a descriptive-analytical method with the help of library tools and the analysis of thematic points and the inference of legal jurisprudential propositions
