چکیده:
شرط، تعهد و التزامی است که ضمن عقد قرار می گیرد و اگر این تعهد تبعی نامشروع باشد که عدم مشروعیت یعنی امر خلاف قانون که البته با توجه به نظری عدالت محور از آقای دکتر کاتوزیان اموری که خلاف اخلاق حسنه و نظم عمومی باشد را نیز نامشروع می داند، باشد سبب بطلان شرط و موجد حق فسخ برای مشروط له خواهد بود. هدف از این پژوهش بررسی شروط خلاف مقتضای عقد در فقه شیعه و انگلیس و فرانسه می باشد. نتایج حاصل از این پژوهش نشان دارد که در حقوق کشور انگلستان نیز مورد بررسی قرار گرفت که این نتیجه حاصل گردید که شروط را به دو دسته اصلی و فرعی تقسیم می کنند و اگر شرط مذکور نامشروع باشد، یعنی با قوانین کامن لا و قوانین مصوب در تضاد باشد، بحث تفسیر و قاعده معروف مداد آبی پیش می آید که نتیجه آن تجزیه قرارداد و اجازه حذف شرط نامشروع را به قاضی اعطاء می نماید، که البته این امر در جایی است که تجزیه قرارداد با نظم عمومی جامعه در تضاد نباشد. درباره مقتضای ذات عقد معیار واحدی در فقه امامی بیان نگردیده است بلکه برخی بر نقش عرف تکیه نموده، برخی پر شرع تمسک جسته و برخی دیگر مدلول اراده انشایی طرفین را ملاک عمل قرار داده اند. از دیدگاه حقوقی و با توجه به ساماندهی تعاریف قراردادهای معین در قوانین به نظر می رسد در وضع فعلی باید در تشخیص مقتضای ذات عقد میان عقود معین و غیر معین تفکیک نمود.

Regarding the necessity of the nature of the contract, a single criterion has not been stated in Imami jurisprudence, but some have relied on the role of custom, some have relied on the Shari'a, and others have used the meaning of the written will of the parties as a criterion for action. From a legal point of view, and considering the organization of the definitions of certain contracts in the laws, it seems that in the current situation, one should distinguish between definite and indefinite contracts in determining the appropriate nature of the contract.
