چکیده:
دستهای از روایات جنگ بنیقریظه دربارۀ کشته شدن فردی از سران این قبیله به نام زبیربنباطا است که از عروهبنزبیر، ابنشهاب زهری، و واقدی نقل شده است. در این روایات آمده است که زبیربنباطا به دست ثابتبنقیس از اسارت آزاد شد اما پس از آزادی درخواست کرد که او را بکشند و مسلمانان درخواستش را اجابت کردند. در این نوشتار روایات مربوط به این واقعه به روش تحلیل اِسناد- متن مورد بررسی قرار گرفت و مشخص شد بخش دوم روایت مبنی بر کشته شدن زبیر اضافهای جعلی بر این روایت بوده است؛ زیرا اطلاعاتی متقدمتر از این روایات موجود است که میگوید ثابتبنقیس دِین خود را به زبیر ادا کرد و او را آزاد نمود. این مطلب کاملاً با بخش اول این روایات سازگار است. به علاوه، زبیر در هنگام کشته شدن فردی آزاد بوده و کشته شدنش ذیل احکام اسیر قرار نمیگیرد، بلکه قتل عمد محسوب میشود که در اسلام نهی شده است. با توجه به این بررسی، تحریف انجام شده احتمالاً توسط زهری و در ربع اول قرن دوم صورت گرفته است. این روایت تحریف شده از اواخر قرن دوم به بعد به صورتهای مختلف در صدور حکم دربارۀ اسیر مورد استناد برخی از فقهای مسلمان قرار گرفته است.
There is a group of narrations about the battle of Bani Qurayzah about the killing of one of the leaders of this tribe named Zabir Ibn Bata, which has been narrated from Urwah Ibn Zubayr, Ibn Shihab al-Zuhri, and al-Waqidi. According to these narrations, Zabir Ibn Bata was released from captivity by Thabit Ibn Qeys, but after his release he asked to be killed and the Muslims complied with his request. In this article, the narrations related to this incident were examined by the Isnad-cum-matn analysis method and it was found that the second part of the narration that Zabir was killed was a fake addition to this narration; because there is earlier information containing that Thabit Ibn Qeys set Zabir free in return of an owe. This is completely consistent with the first part of these narrations. In addition, Zabir was a free man when being killed, and his killing is not subject to captive sentences, but is considered murder which is forbidden in Islam. According to this study, the distortion was probably done by al-Zuhri in the first quarter of the second century. This distorted narration has been used in various ways in the jurisprudence of some jurists of Islamic school of thought since the end of the second century in issuing a sentence on a captive.
