چکیده:
حق حبس به معنی حقّ خودداری یک طرف عقد معاوضی، از اجرای تعهّد خود، تا اقدام طرف دیگر به اجرای تعهّدش می باشد. قریب به اتفاق فقها موافق اجرای حق حبس در عقود معاوضی هستند، ولی در رابطه با جریان حق حبس در نکاح بدین معنی که زوجه حق داشته باشد تا زمانی که مهر به طور کامل به او تسلیم نشده از ایفای وظایفی که در مقابل شوهرش دارد ، امتناع کند مشروط به این که مهر او حال باشد وتمکین خاص صورت نگرفته باشد؛ آراء متفاوتی در میان فقها به چشم می خورد. مشهور فقهاء، با استناد به ادله ی مختلف مانند معاوضی بودن ماهیت عقد نکاح، روایات، اجماع، قاعده ی نفی ضرر و حرج و شرط عرفی ضمن عقد، بر مشروعیت این حق تأکید نموده اند. در این میان تعداد معدودی از فقها به مخالفت با جریان حق حبس در نکاح برخاسته و با مخدوش دانستن ادله و مبانی حق حبس در نکاح، منکر این مطلب شده اند. تنها ابن ادریس قایل به تفصیل در این رابطه است ایشان جریان حق حبس را در صورت ایسار زوج صحیح دانسته و در صورت اعسار زوج، آن را نمی پذیرد. جستار حاضر با روش توصیفی- تحلیلی و با هدف تبیین و نقد دلایل قایلین به حق حبس در نکاح ضمن معرفی دیدگاه های مختلف فقهای امامیه و مبانی ایشان در خصوص حق حبس در نکاح، به این مساله پرداخته و از این رهگذر حق حبس در نکاح را نفی می نماید.

In the meantime, a few jurists have opposed the process of imprisonment in marriage and have denied this by confusing the grounds and grounds of imprisonment in marriage. Only Ibn Idris elaborates in this regard, and he considers the right to imprisonment to be valid if the couple is found guilty and does not accept it if the couple is found guilty. This descriptive-analytical study, while presenting different views of Imamite jurisprudents and their foundations on the right to imprisonment in marriage, deals with and criticizes the reasons for the imprisonment right in marriage and thereby negates the right to imprisonment in marriage.
