چکیده:
دادرسی اساسی که مبتنی بر برتری قانون اساسی بر سایر قوانین و نیز لزوم حفظ آزادی بنیادین شهروندی در مقابل مداخلات دولتی پایه گذاری شده است، در نظام های قانونی مختلف مبتنی بر تفویض امور به نهادهای سیاسی، قضایی، اداری و حتی قانونی است. این تحقیق که با رویکرد توصیفی- تحلیلی صورت پذیرفته است، سوال اصلی تحقیق بدین صورت است که چه وجوه تفاوت و شباهتی میان نظام دادرسی اساسی در حقوق ایران و آلمان وجود دارد؟ در کنار شباهت هایی هم چون قاعده منع اشتغال اعضای نهادهای دادرسی اساسی، در سایر زمینه ها مانند ساختار و تشکیلات این نهادها، قابل نقض بودن تصمیمات آن ها، لزوم انتشار آن ها در روزنامه رسمی تفاوت های قابل توجهی وجود دارد. یافته های تحقیق حاضر نیز بدین صورت است که اولا بایستی سایر اختیارات تطبیق قوانین با قانون اساسی از جمله در زمینه مجمع تشخیص مصلحت نظام به شورای نگهبان تفویض شود ثانیا مدت عضویت اعضای شورا به مانند دادگاه قانون اساسی آلمان به مدت یک دوره بوده و قابل تمدید نباشد ثالثا تصمیمات و آراء شورای نگهبان صرفا در امور ماهوی بوده و به مانند دادگاه قانون اساسی آلمان در زمینه صدور امور شکلی مانند دستور موقت نیست رابعا بایستی ترکیب عضویت در شورای نگهبان به نحوی تغییر پیدا نماید که به مانند دادگاه قانون اساسی آلمان، امکان عضویت قضات دیوان عالی کشور فراهم شود. علاوه بر موارد فوق در این مقاله به بحث مبانی دو دادرسی اساسی و آسیب شناسی شورای نگهبان در ایران و ارائه راهکار پرداخته شده است.

Thirdly, the decisions and decisions of the Guardian Council are purely substantive and are not, like the German Constitutional Court, a temporary order; therefore, the composition of the Guardian Council must be changed so that, like the German Constitutional Court, the possibility of membership Provide Supreme Court justices.
