چکیده:
امروزه ورزش حرفهای در سراسر جهان گسترش یافته و اسناد بینالمللی نیز به نوعی به ورزش توجه کرده است. برگزاری بیشمار مسابقات ورزشی داخلی و بینالمللی موجب بروز مشکلات حقوقی و اختلافات قراردادی و غیرقراردادی میشود که باید توسط نهادهای تخصصی ورزشی حل و فصل شود. در این مطالعه از روش تحلیل محتوا از نوع متنی استفاده شده است. در مطالعه حاضر آرایی که در دادگاه بینالمللی داوری ورزش (CAS) درباره پروندههای مربوط به ورزش ایران صادر شده است مورد بررسی و تجزیه و تحلیل قرار گرفت. طبق بررسیهای صورتگرفته در دادگاه عالی ورزش (CAS) پروندههایی مربوط به ورزش ایران تشکیل میشود که فقط هزینه به همراه دارد. بررسی پروندهها نشان میدهد که عملا بر سر هر موضوعی، فوتبال ایران پروندهای در (CAS) دارد. از سه بر صفر شدن یک بازی بر اساس قوانین فوتبال ایران گرفته تا فسخ قراردادها توسط بازیکنان و مربیان. دادگاه عالی ورزش مکانی است که به عنوان بالاترین نهاد قضایی ورزشی به آن مراجعه میشود اما در ایران سالهاست که رویه متفاوت شده و اهدافی غیر از منافع ایران، دلیل مراجعه به این دادگاه شده است. نیاز است که نهادهای نظارتی به پروندههایی که ایران طی سالهای اخیر در مجامع بینالمللی باخت ورود کند. دفاع از حقوق افراد و نهادها در مراجع حل و فصل اختلافات مرتبط با ورزش، نیازمند در اختیار داشتن دانش تخصصی و تجربه کافی در این حوزه است.
AbstractToday, professional sports have spread all over the world and international documents have also paid attention to sports. Holding numerous domestic and international sports competitions causes legal problems and contractual and non-contractual disputes that must be resolved by specialized sports institutions. In this study, the method of content analysis of the text type is used. In the present study, the opinions issued by the International Court of Arbitration for Sport (CAS) regarding cases related to Iranian sports were analyzed. According to the investigations carried out in the Supreme Court of Sports (CAS), cases related to Iranian sports are filed, which only bring costs. Examining the cases shows that Iranian football has a case in (CAS) on practically every issue. From three to zero in a game according to Iranian football rules, to the termination of contracts by players and coaches. The Supreme Sports Court is a place that is referred to as the highest sports judicial institution, but in Iran, the procedure has been different for years and goals other than Iran's interests have become the reason for referring to this court. There is a need for regulatory bodies to enter the cases that Iran has lost in international forums in recent years. Defending the rights of individuals and institutions in sports-related disputes resolution authorities requires having specialized knowledge and sufficient experience in this field.
