چکیده:
زمینه و هدف: متاثر از صنعتی شدن جوامع و رقابت های صنعتی در جهان، محیط زیست مورد هجوم همراه با تخریب بشر قرار گرفته به نحوی که امروزه متاسفانه محیط زیست، تابعی از توسعه در صنعت لحاظ شده و تنوع در نیازهای بشری با برهم خوردن نظم زیست محیطی و حتی بروز خسارت های غیرزیست محیطی همراه گردیده است. جرایم زیست محیطی در اشکال مختلف نمونه ای از بر هم خوردن توازن رابطه انسان با طبیعت بوده که بشر با هدف سهم خواهی و به دست آوردن سود بیشتر در مسیر از بین بردن طبیعت قرار گرفته است. آلودگی نفتی دریایی از شایع ترین آسیب های زیست محیطی بوده که بدلیل نوع آلودگی و میزان پایداری بعضاً منتهی به ورود خسارات جبران ناپذیری به محیط زیست بشری شده و اصلیترین منبعی که میتواند در دریاها ایجاد آلودگی نماید، نشت مواد نفتی است. جامعه جهانی با واکنش های مختلفی در قالب تدوین قانون، کنوانسیون و اسناد بین المللی در مواجهه با موضوع از خود نشان داده است. با این توضیح محقق در این جستار تلاش دارد تا ضمن تحلیل ابعاد مسئولیت دولت ها در رابطه با جبران خسارت های ناشی از آلودگی نفتی دریایی، موضوع را از منظر حقوق، اسناد و آرای دادگاه های بین المللی مورد بررسی قرار دهد و در سایه این هدف به سوالاتی از جمله اینکه دولت ها چه مسئولیتی در قبال آلودگی دریایی ناشی از مواد نفتی دارند؟ و اینکه حقوق و اسناد بین المللی چه واکنشی در رابطه با آلودگی دریایی ارائه نموده؟ و اینکه اصولاً تدابیر جامعه ی جهانی چقدر تاثیرگذار بوده است؟روش تحقیق: این تحقیق از حیث هدف کاربردی و از نظر روش، توصیفی- تحلیلی است. در این تحقیق برای پرداختن به موضوع و پاسخ به سوال از طریق گردآوری اطلاعات با روش کتابخانه ای و با استفاده از فیش برداری منابع و همچنین بهره برداری از سایت های خبری و مقالات تخصصی استفاده شده است.نتایج و یافته ها: بررسی های انجام شده از قضایای آلودگی نفتی دریایی در سطح بین المللی ناظر بر این است که علی رغم آثار ناشی از خسارت های زیان بار زیست محیطی و غیرزیست محیطی، همچنان در سایه تعارض منافع، عدم نفع، عدم ورود ضررهای مستقیم بین دولت های ساحلی و صاحب پرچم در محیط بین الملل نتوانسته در سایه مسئولیت بینالمللی دولت ها، محیط زیست دریایی را از مخاطرات آلودگی نفتی حفظ کند و این رویکرد نشان دهنده ی ناکارآمدی نظام مسئولیت مدنی در پیشگیری، کاهش و مقابله و مواجهه با آلودگی دریایی است با توجه به مصادیق گسترده آلودگی نفتی در سطح آب های بین المللی و ورود خسارات گاه غیرقابل جبران بر محیط زیست دریایی و تأثیرات سوء اقتصادی آلودگی نفتی دریاها، همگی مؤید لزوم توسل به ساختار قضایی کارامد، نظام مسئولیت کیفری پویا و ایجاد ضمانت اجراهای قوی در نظام بین الملل خصوصاً در رابطه با دریای آزاد، که زیان دیدة واقعی«بشریت» است. حقوق بین الملل هنوز به آن درجه از پیشرفت نرسیده است که دولتی بتواند به نمایندگی از منافع بشریت اقدام به اقامة دعوی نماید. ولی به نظر می رسد، چنانچه اقدام به آلودگی از سوی کشورها، نقض یکی از مقررات مذکور در کنوانسیون حقوق دریاها(1982) یا قوانین و مقررات دیگر یا عرف بین المللی باشد، هر کشوری می تواند با استناد به مادة 48 مسئولیت بین المللی دولت ها، به طرح دعوی جبران خسارت آلودگی نفتی در دریای آزاد اقدام کند.

Marine oil pollution is one of the most common environmental damages, which due to the type of pollution and the level of stability, sometimes leads to irreparable damage to the human environment, and the main source that can cause pollution in the seas is oil spills. The international community has shown various reactions in the form of drafting laws, conventions and international documents in facing the issue. With this explanation, the researcher in this essay tries to analyze the dimensions of governments' responsibility in relation to the compensation of damages caused by marine oil pollution, and examines the issue from the perspective of laws, documents and opinions of international courts, and in the shadow of this goal To questions such as what governments are responsible for marine pollution caused by petroleum products? And what is the reaction of international laws and documents in relation to marine pollution? And how effective have the global community's measures been?Research method: This research is applied in terms of purpose and descriptive-analytical in terms of method. In this research, to deal with the issue and answer the question, it is used to collect information with the library method and by using the sources, as well as using news sites and specialized articles.Results and Findings: The studies conducted on marine oil pollution cases at the international level observe that despite the effects of harmful environmental and non-environmental damages, it is still under the shadow of conflict of interests, lack of benefit, lack of loss. The direct relationship between the coastal governments and the flag owner in the international environment has not been able to protect the marine environment from the dangers of oil pollution in the shadow of the international responsibility of the governments, and this approach shows the inefficiency of the civil liability system in preventing, reducing and confronting pollution.
