چکیده:
چکیده: موضوع مقاله حاضر آینده پژوهی تاثیر تحول مفهوم تجاوز در کنفرانس کامپالا (2010) بر کیفیت تعامل ایران با دیوان کیفری بین المللی است. این پژوهش شامل سه بخش میباشد. بخش نخست طرح مساله، کلیات پژوهش و بررسی منابع موجود را شامل میگردد. در بخش دوم به بررسی پیشینه کنفرانس کامپالا و تحول مفهوم تجاوز پرداخته میشود و در نهایت در بخش سوم سناریوهای محتمل و مطرح در ارتباط با کیفیت احتمالی تعامل ایران با دیوان کیفری بین المللی بر اساس تعریف تجاوز در حقوق بین الملل کیفری مورد بررسی قرار میگیرد. در پایان جمع بندی شده است که تعریف تجاوز در کنفرانس کامپالا و همچنین انحصاری نبودن شروع تحقیقات درخصوص ارتکاب تجاوز به تشخیص شورای امنیت ملل متحد، دو شاخص مهم در موفقیت کشورهای درحال توسعه دراین کنفرانس میباشد. این دو شاخص مهم و مثبت در روند متعادل تدوین حقوق کیفری بین المللی، احتمال تغییر وضعیت عضویت ایران و الحاق به اساسنامه دیوان را در زمان مناسب تقویت میکند.
This paper intends to predict the possible reactions of Iran to the International Criminal Court (ICC) in light of the definition of “aggression” in Kampala Conference (2010). This Paper is organized in three parts.The first part presents the question, research methodology and the literature review. The second part includes the background of the Kampala Conference and the development of the concept of “aggression” in ICC. The third part delves around future scenarios of Iran’s reaction to the definition of “aggression” at the Conference.The paper concludes that the definition of “aggression” at the Conference, and the non-exclusive authority of the UN Security Council to trigger a new case of possible occurrence of “aggression” are two important features of the Conference that reflect the success of the developing countries. These two important features in balanced development of international criminal law, is argued, to enhance the likelihood of Iran changing its observer membership and acceding to the Statute of the ICC Statute at an opportune time.
