چکیده:
زمینه و هدف: درباره اکراه در قتل نظر قریب به اجماع فقهای شیعه آن است که اکراه شونده قصاص میشود و اکراه کننده به حبس ابد محکوم میشود. البته آیتالله خویی معتقد است اکراه شونده میتواند مرتکب قتل شود؛ که در این صورت به پرداخت دیه محکوم شده، اکراه کننده به حبس ابد محکوم میشود. مستند ایشان این است که در چنین موردی دو تکلیف غیرقابلجمع برای اکراه شونده پدید آمده است؛ از یکسو کشتن دیگری حرام است و از سوی دیگر حفظ نفس واجب است و چون نمیتواند هر دو تکلیف را امتثال کرد، اختیار دارد هر یک را خواست، انجام دهد. یعنی این مورد از موارد تزاحم در امتثال در تکلیف غیرقابلجمع است. البته اگرچه بر مباشر به دلیل فقد عنوان، قصاص ثابت نیست اما دیه درهرحال بر او ثابت است؛ چون خون مسلمان هدر نمیرود و اکراه کننده نیز به حبس ابد محکوم میشود.
روش: پژوهش حاضر به روش توصیفی و تحلیلی انجامشده است.
یافتهها و نتایج: هرچند نظر ایشان در قانون مجازات اسلامی پذیرفتهنشده است اما این نظر گاهی با واقعیت خارجی بیشتر تطابق دارد و افراد در چنین وضعیتی مرتکب قتل میشوند. در این موارد میتوان اکراه کننده را به قصاص نفس محکوم کرده و او را سبب اقوی از مباشر بدانیم. به نظر میرسد دیدگاه مرحوم خویی در موردی که اکراه به حدی رسد که توانایی سنجش سود و زیان را از مکره بازستاند و برخلاف خواست درونی او را ملزم به ارتکاب قتل نماید (الجاء) از منظر حقوق کیفری قابل دفاع است، شاید به همین دلیل تطابق با واقعیت خارجی است که قانونگذار در راستای پذیرش نظر مشهور فقها، ماده 380 ق.م.ا در سال 1392 به تصویب رسانید.

Of course, although the retribution is not fixed on the steward due to the lack of title, but the payment is fixed on him in any case; Because the blood of a Muslim is not wasted and the one who refuses will be sentenced to life imprisonment. Method: The present research was carried out using a descriptive and analytical method.
Finding and Conclusion: Although his opinion is not accepted in the Islamic Penal Code, but this opinion is sometimes more consistent with external reality and people commit murder in such a situation. In these cases, the reluctance person can be sentenced to self-retribution and considered to be the cause of the misbehavior.It seems that the late Khoi's point of view is defensible from the point of view of criminal law in the case where the reluctance reaches the point where it prevents the ability to measure profit and loss from makraa and obligates him to commit murder against his inner will (al-ja'a), perhaps for this reason It is a foreign fact that the legislator passed Article 380 of the Islamic Law in 1392 in line with the opinion of famous jurists.
