چکیده:
ادلة اثبات دعوا نقش بسزایی در پیشبرد اجرای عدالت در دادرسی های بینالمللی دارد. در دعاوی بینالدولی این دولتها هستند که خود بهعنوان اطراف دعوا اقدام به تحصیل و ارائة ادله میکنند و گاهی احتمال دارد که یکی از طرفها با نقض حقوق بین الملل، اقدام به جمعآوری ادله کند. قابلیت پذیرش ادلة تحصیلشدة غیرقانونی، موضوعی بحثبرانگیز در رویهقضایی و آموزههای علمای حقوق بینالملل است. ازجمله این موضوع اخیراً با انتشار اسناد دیپلماتیک از طریق تارنمای ویکیلیکس مورد بحث قرار گرفته است. در برخی از قضایای بینالمللی، اصحاب دعوا کوشیدهاند از این تلگرافها بهعنوان دلیل اثبات حقیقت در محضر دادگاههای بینالمللی و داخلی بهره جویند. پژوهش حاضر تلاش دارد تا به این سؤال پاسخ دهد که قابلیت پذیرش تلگراف های دیپلماتیک افشاشده در رویة دادرسی های قضایی بین المللی چه جایگاهی دارد. مقاله نشان میدهد که علیرغم اهمیت یافتن ادلة اثبات دعوا، تا زمانی که اطراف دعوا ایراداتی را بر ادلة ارائهشده مطرح نکنند، دادگاه ها و دیوان های بین المللی اکراه دارند که به ابتکار خود، قابلیت پذیرش ادلة ارائهشده را بررسی کنند. در این پژوهش در وهلة نخست، مبانی نظری قابلیت پذیرش ادلة تحصی لشدة غیرقانونی در حقوق بین الملل بررسی و سپس به رویة بین المللی در خصوص قابلیت پذیرش تلگراف های دیپلماتیک افشاشده پرداخته شده است.
Evidence plays an important role in advancing the administration of justice in international proceedings. In international litigation, states present evidence, and sometimes it is possible for one of the parties to collect evidence in violation of international law. The admissibility of illegally obtained evidence is a contentious issue in jurisprudence and the doctrines. This issue has recently been discussed with the leak of diplomatic documents through the WikiLeaks website. In some international cases, the plaintiffs have tried to use these cables as evidence to prove a fact in the presence of international and domestic courts. The present study seeks to answer the question of what is the place of admissibility of disclosed diplomatic cables in the procedure of international judicial proceedings? The article shows that international jurisprudence, despite the importance of the evidence, the international courts, and tribunals do not examine the admissibility of evidence. In this research, in the first place, the theoretical foundations of the admissibility of illegally obtained evidence in international law have been investigated. Then, the international procedure regarding the admissibility of disclosed diplomatic cables is discussed.
