چکیده:
اصل تقدم صلاحیت یا ضرورت اتخاذ تصمیم در نزدیکترین نقطه به فرد اصلی است؛ فلسفهای که در چند دهة اخیر در برخی از نظامهای سیاسی و حقوقی ارزیابی و اجرا شده است. نظام حقوق اساسی آلمان و از همه مهمتر نظام اتحادیۀ اروپا به فضایی برای اجرای عملی این اصل تبدیل شدهاند. با این همه اجرای این اصل خالی از چالشهای حقوقی خاص نیست. در نظام حقوقی اتحادیه تجربة ربع قرن از اجرای این اصل حاکی از دشواریهای عدیدهای است که در سطح سیاسی و قضایی، یکی از موفقترینهای نظامهای همگرایی منطقهای را با چالشهای زیادی روبرو کرده است. مقالة حاضر با نگاهی انتقادی به پیشینه و اجرای این اصل برای تحقق مردمسالاری محلی در اتحادیۀ اروپا تلاش دارد تا دلایل و اسباب موفقیتها و ناکامیهای این اصل را از نگاهی حقوقی ارزیابی و بررسی کند.
The principle of subsidiarity or necessity of making the decision at the closest point to the principal is a doctrine that has been evaluated and implemented in some political and legal systems in recent decades. The German constitutional system, and most importantly the EU system have enabled the practical implementation of this principle. The application of this principle, however, is not without challenges. In the EU legal system, a quarter-century of experience in implementing this principle implies a number of difficulties that challenge one of the most successful regional political and judicial systems. By critically evaluating the background and implemention of this principle of EU law in terms of local democracy, this paper seeks to examine the reasons and the implications of its successes and failures from a legal point of view.
