چکیده:
امروزه برداشتهای سنّتی از فقه امامیه و قوانین موضوعه مبنی برمشخصشدن همه ابعاد معامله در لحظه انعقاد، امری دشوار و در مواردی ممتنع شده است. ازسویی واکاوی در منابع فقهی در باب قاعده غرر و مجموع مقررات موضوعه نشان میدهد هر جهلی که در آن احتمال ضرر میرود مؤثر در بطلان قرارداد نیست و ازاینجهت ابهامات معاملی به دو شق مؤثر و غیرمؤثر در ایحاد غرر و بطلان عقد قابل تقسیم میباشد. مشابه این تقسیمبندی در حقوق مصر دیده میشود و غرر به «مؤثر» و «غیرمؤثر» تفکیک و دراینراستا غرری که مقتضای معاملات روز باشد و مورد اعتنای عرف عقلا نباشد، غیرمؤثر در بطلان محسوب میگردد. این تقسیمبندی در فقه امامیه نیز با اندکی تسامح قابل توجیه است؛ چراکه در فقه، غرر بهمعنای خطر بوده و خطر نیز احتمال ضرری است که عرف عقلا از آن اجتناب میکنند؛ بنابراین اگر عرف بهجهت نیازهای اجتماعی و در عین حال قابل اغماضبودن ابهام از آن رویگردان نبوده، بلکه بدان اقبال کند، چنین جهلی اساساً غرر محسوب نشده و یا به تعبیر مشتمل بر مسامحه حقوق دانان مصر، متضمن غرر غیر مؤثر در صحت یا بطلان قرارداد می باشد. در تحقیق حاضر با گردآوری اطلاعات از منابع کتابخانهای و دیجیتالی و با استفاده از روش تحلیلی نسبت به کشف حکم و تحلیل آن و ارائه راهکارها اقدام شده است.
