چکیده:
رژیم بعث صدام در جریان جنگ هشت ساله بارها به نحو مستقیم یا غیرمستقیم غیرنظامیان، اعم از کودکان و زنان و کهنسالان و سایر گروه های انسانی غیرمرتبط با جنگ و جنگاوری را مورد تعرض، جرح و کشتار قرار داد. نسبت سنجی این اقدامات با قواعد فقهی از آنجا اهمیت می یابد که صدام و رژیم بعث جهت جلب حمایت سایر کشورهای اسلامی و عربی در جنگ با ایران و مقابله با آمریکا و اسرائیل، تظاهر به التزام نسبت به احکام اسلام می نمود. هدف از مقاله پیش رو آن است که میزان التزام رژیم بعث صدام به قواعد فقهی مربوط به جنگ را نشان دهد. روش تحقیق نیز بدین صورت خواهد بود که با بررسی ادله و مستندات قرآنی و روایی، مبانی نظری ممنوعیت تعرض به غیرنظامیان و قواعد حاکم بر رفتار با غیرنظامیان در جنگ را بدست می آورد و سپس مصادیقی از نقض این قواعد توسط رژیم بعث در جنگ تحمیلی عرضه خواهد کرد. مبانی نظری ممنوعیت تعرض به غیرنظامیان در این مقاله بر اساس ادله و مستندات مشترک در میان مذاهب اسلامی و بدون ورود به انفرادات و اختلافات مذاهب بررسی می گردد تا از منظر فقه همه مذاهب اسلامی قابل استفاده باشد. نتیجه حاصل از این مقاله نشان خواهد داد که رژیم بعث نه تنها التزامی به قواعد اسلامی مربوط به ممنوعیت جنگ با غیرنظامیان ندارد، بلکه در موارد بسیاری با هدف تخلیه ایران از نژاد ایرانی و جایگزین کردن نژاد عراقی، عامدانه در تلاش برای کشتار وسیع تر غیرنظامیان در جنگ تحمیلی می باشد.
