چکیده:
اصل برابری و تساوی افراد در برابر قانون به موجب بند 14 اصل سوم قانون اساسی، پذیرفته شده است، اما قانون مجازات اسلامی مصوب 1392 به تبعیت از فقه امامیه، جنسیت را در اجرای برخی از مجازاتها از جمله حدود دخیل دانسته است. در مجازات حد زنا که در این مقال مورد مداقه قرار میگیرد، تفاوتهای زیادی در شرایط و نیز کیفیت اجرای حد زنا ملاحظه میگردد. با توجه به اینکه تاثیر جنسیت در مجازات افراد، خلاف اصل برابری و مساوات در برابر قانون است، لذا، ثبوت آن نیازمند توجیهات مستحکمی میباشد؛ عمده دلیل ارائه شده برای این نابرابریها فارغ از اخباری که در برخی از مصادیق وارد شده است، رعایت مصالح طرفین میباشد. ازاینرو در تحقیق حاضر سعی شده است تا با روش توصیفی، تحلیلی و با استناد به منابع کتابخانهای با بررسی مفهوم «برابری و مساوات» در اسلام و نیز مداقه در آیات قرآن و بررسی جایگاه برابری جنسیتی در آیات مربوطه و همچنین احصاء مصادیق نابرابری در شرایط و کیفیت اجرای حد زنا در قانون، دیدگاه فقیهان امامیه و ادله مطرح شده از سوی هر یک مورد دقت و بررسی قرار گیرد تا میزان عنایت قانونگذار به مصالح طرفین تعیین گردد. با ملاحظه این دیدگاهها روشن میگردد که نابرابری جنسیتی، تنها در برخی از مصادیق، مثبت و منطبق با مصالح طرفین بوده است و در سایر موارد که عبارتاند از محتمل الوقوع بودن اکراه بر زنا نسبت به مرد، ثبوت حکم اعدام برای زنا با همسر مادر و نابرابری در تعریف ارائه شده در احصان، در راستای مصالح ایشان نمیباشد.
